Provincial Court Proceedings, 1672/3. 81 shall acknowledge the Demise Entry and actuall Expullsion or in Liber M M Default thereof Judgemt shalbe Entred, agt the Defendt Hugh Connell the Casuall Ejector, but any further psecution against him shalbe spared untill the said Henry & Sophia shall make default of the prmises and by the assent of the Councell it is further ordered that the said Henry and Sophia shall take no advantage agt the pit for his, not psecuting upon the tryall occasioned by his Default but the said Henry and Sophia shall pay to the plt the Costs by the Cort to be Taxed thereupon, and it is further ordered that the Lessor plt shalbe Chargeable with the paymt of the Defendts costs by the Cort allowed by any meanes Ta James Nuthall agt Thomas Sprigg Philip Udall agt Henry Mitchell Henry Hosyer & John Stagnes agt Francis Kilbourne Roger Baker agt Thomas Gaunt Vincent Atchinson agt Marke Cordea Wittm Harris agt Tho: Bennet Marmaduke Syms agt John Richardson Thomas Notley agt Nehemiah Blackiston John Larkin The agt Cort ffrancis Gill The Respective Attorneys to the Severall De fends appeare for their Clyents, and crave an Imparliance untill the next Provinciall Court, and it is graunted unto them and the same day is given unto the said Respective plts likewise. The Sheriff having Retorned a Cepi & the Defendt neither apearing in pson nor by At torney ordered that the Sheriff be amerced 40s unlesse he bring him the next Provincial Cort. defendt appeared in his pp pson, and was by the ordered to Retaine an Attorney. |
