674 Appendix. LiberP.C.R. Capt Willm Lewis his howse, where hee saw John Butteris sett up a Tob. howse, wch howse bee deposeth was built by ye sd John from ye grownd. But what Timber he made use of wch formerly belonged to a Sixty foote howse standing about three or fowre hundd paces, from ye place, where hee sett up this hee Knoweth not. & further sayth not. Sworne before mee. Samuel Packer. ye 15th of Octobr 1659 Josias ffendall. Decemb Wednesday 7th of Decembr 1659 S Command Henry Ellery & Elizabeth his Wife to hold plea to Willm Watts in an accön of Couent of a Parcell of Land of One hundd Acres adioyning to his Lps mannor of West St Maries on ye West Side of St Georges Riuer. Being ye halfe of Two hundd Acres men tioned in a Patent graunted to Philip West bearing date ye 3d of August 1640, & Signed by Leonard Caluert Esp Gouernor of this Prouince under ye Right honble ye Ld Proprietary thereof. Which Pattent is since come to bee ye Right of ye sd Henry Ellery by marry ing the sd Elizabeth, the Relict of Willm Stephenson deceased. Philip Caluert. And ye finall Concord betweene ye forenamed parties is, That ye sd hund Acres (wth all ye edifices thereon) Beginning & Lying on ye Sowth East side of a Runne called ye dividing Runne, & soe running nortwest with Crany Creeke be conueyed to him the sd Willm Watt (who marryed one of ye Daughters of ye sd Willtm Stephenson & Elizabeth aforesd) & ye same to enjoy to him his Heyres & assignes for euer. Att a Prouinciall Court holden att ye Resurrection mannor in Caluert County this 12th of Decembr 1659. Philip Caluert Esqr Secry Councellrs ifendall Esq Gouernor Baker Brooke Order passed this Court on ye 7th of Octobr last . . . as Cornewaleys plt, & ye Estate of Capt William . . . by it is Ordered yt a Certaine Attatchmt uppon . . . ell, the sd Thomas Cornewaleys p. 325 sayd, should bee referred to ye County Court for ye County of St Maries. There uppon proofe of ye sd Debt to receiue Judgmt. And whereas ye sd Court for want of power in the Attorney then appearing, haue not Ordered any thing in ye sd busines. Vppon sight of a Bill signed by ye sd Mitchell for Eight hundd & sixty pownds of Tob, dated ye 15th of August 1658. & underwritten more due uppon ye abouesd fifty pownds of Tob & Cask. And againe more due since the Bill by Thomas Tunnell, Two yards of Spanish Cloath Three hundd & Eight pownds. & subscribed Willm Mitchell. The Court doe Judge That ye Tob attatched in ye hands of John |
