dampnified & hath losse to the value of ten thousand pounds of Liber M M
tobacco & thereupon he bringeth his suite.
And the Said John Wells by Keneim Cheseldyn his Attorny corn
eth and defendeth the force and injury when &c and prayeth liberty
of Speakeing hereunto untill the next Provinciall Court & it is
granted him the same day is given to both parties.
Now here at this day to wit the twentith day of November in the
44th yeare of the Dominion of Caecilius &c Came the said Charles
Calvert Esq by his Attorny aforesaid & Offered himselfe against
the said John Wells in the plea aforesaid & the said John Wells in
his proper person came likewise & Saith that he saith nothing in
barr or avoidance of the action aforesaid of him the said Charles
Calvert for that he oweth unto the said Charles the said Summe of
eight thousand pounds of tobacco in manner & forme as the said
Charles hath above declared against him Therefore it is considered
by the Court here that the said Charles recover against the Said
John the said Summe of eight thousand pounds of tobacco the debt
aforesaid as also the summe of pounds of tobacco
costs of Suite.
Evan Carew Robert Proctor late of Ann Arundell County In
agt holder was attached to answer unto Evan Carew of
Robert Proctor a plea of trespas upon the case.
And the Said Evan by Robert Carvile his Attorny Saith that
whereas the Said Robert Proctor upon the last day of June One
thousand Six hundred Seventy three did Keepe an Ordinary at the
head of South River in the said County and the said Robert being
at that time destitute of a Servant to Keepe his bookes and ac
compts and asist him the said Robert in the Keeping and lookeing
after the said Ordinary and attending the Guests resorting thither
a certaine Communication was had between the said Robert & Evan
touching the said Roberts hireing and reteineing him the said Evan
to be his the said Roberts Bookekeeper and to doe all such things
as to the imployment of a Bookekeeper was necessary & convenient
He the said Robert did in consideration that the said Evan Carew
would be his the said Roberts Bookekeeper aforesd and looke to his
bookes and accompts & asest him in the Keeping the said Ordinary
& attending his quests assume upon himself e & to the Said Evan
faithfully promise that he the said Robert would find & provid for the p. 636
Said Evan Sufficient meate drinke lodging & other necessary ac
comodations for and dureing all the tyme & terme he Should Stay &
continue in the said imployment and would also satisf[ie] and pay
unto the Said Evan for every month he Should Stay & continue in
that imployment of Bookekeeper the Summe of three hundred thirty
nine pounds of tobacco when thereunto he should be required And
the Said Evan in fact Saith that he giveing Creditt to the promises
