Provincial Court Proceedings, 1675. 599 did sell & deliver the said Servant unto the said William for three Liber M M thousand pounds of tobacco to be paid as aforesaid Notwithstanding which the said William the said summe of three thousand pounds of tobacco according to his promise to him the said Marmaduke hath not paid though often thereunto required but the same to him to pay hitherto hath & still doth deny to the damage of the said Marmaduke the summe of six thousand pounds of tobacco And thereupon he bringeth his suite. And the said Wm by Robert Ridgely his Attorny cometh & de fendeth the force & injury when &c and prayeth liberty of Speake ing hereunto untill next Provinciall Court & it is granted unto him the same day is given to both parties. Now here at this day to wit the foure & twentith day of November in the 44th yeare of the Dominion of Caecilius &c Annoq Doth 1675 came the said Marmaduke by Kenelm Cheseldyn his Attorny but the said Wm King came not therefore it is considered by the Court here that the said Marmaduke recover against the said Wm King the said summe of three thousand pounds of tobacco for his damages Occasioned by the trespas aforesaid as also the summe of five hun dred twenty eight pounds of tobacco costs of Suite & the said Wm in mercy. John Harris Richard Whitty late of Somersett County Cooper agt otherwise called Richard Whitty of Somersett Richard Whitty County in the Province of Maryland was sumoned to answer unto John Harris of a plea that he render unto him the just & full summe of three thousand two hundred weight of good Sound merchantable tobacco without ground leaves or Seconds with caske which to him he oweth & unjustly deteineth And whereupon the said John Harris by Robert Ridgely his At torny Saith that whereas the said Richard the eleventh day of Janu ary in the yeare of Our Lord 1672 by his certaine bill Obligatory Sealed with the seale of him the said Richard and here in Court produced whose date is the day and yeare aforesaid did bind him self e his heirs executrs admts or assignes to pay or cause to be paid to the said John Harris his heirs executors admrs or assignes the full and just summe of three thousand two hundred weight of good Sound merchantable tobacco without ground leaves or seconds with caske to be paid at all demands at some convenient landing Not withstanding which the Said Richard the Said summe of three thousand two hundred pounds of tobacco to him the said John ac cording to the tenor of the same bill though often demanded hath p. 577 not paid (though) but the same to pay hath denyed & as yet doth deny to the damage of the said John foure thousand pounds of tobacco & thereupon he bringeth his suite |
