388 Provincial Court Proceedings, 1674. Liber M M Job Corner in ejectment. agt the Survey with the Verdict of the jury to en- Robert Ingoldsby quire of and upon the land in question being returned this cause continued untill next Court. Thomas Taylor of Dorchester County planter was admitted in form a pauperis and chose Keneim Cheseldyn his Attorny who was allowed off by the Court here John Hilliard this cause being upon an appeale from the County agt Court of Somerset County and the defendant ap George Johnson peareing by Robert Carvile his Attorny and the plaintiff makeing default herein Ordered that a pro cedendo be granted the defendant in this cause. Samuel Chew Esq and Robert Conant being Summoned as evi dences on the part of Thomas Chandler and Wm Russell at suite John Wells and the cause being dismist and attending here when the same Should come to tryall Ordered that the Said Thomas Chandler and Wm Russell Satisfie & pay to the said wittnesses nine hundred and twenty pounds of to bacco apeice for their Attendance, horses and fferrying their horses. Samuel Winslow admr of Henry agt John Bowles executr Wm Battin Webb John Bowles late of Charles County Gent executor of the last will and Testament of William Battin merchant de ceased was attached to an swer unto Samuel Winslow Administrator of the goods and Chattells of Henry Webb mercht deceased in a plea of trespas upon the case. And whereupon the said Samuel by John Morecroft his Attorny complaineth that whereas the said Wm Battin in his life time to witt the 22th day of April in the yeare 1654 Stood indebted to the Said Henry Webb in his life time (to witt the two and twentith day of April in the yeare aforesaid) in the sume of twenty pounds Sterling and for thirty pounds in provisions In consideration thereof did assume upon himselfe and to the said Henry did faithfully promise to pay or cause to be paid to the said Henry Webb or his assignes Vizt to Joshua Woolnough or whom the Said Henry should Order in London to receive the full Summe of fifty pounds Sterling and the Said William did also in his life time then and there also assume |
