376 Provincial Court Proceedings, 1674.
Liber M M Speakeing hereunto untill the next Provinciall Court and the Same
day is given to both parties.
Now here at this day to witt the twelfth day of December in the
43th yeare of the Dominion of Caecilius &c came the Said John
Bailey by George Old feild his Attorny and the Said Richard Bayiy in
his proper person likewise came and the Said Richard Saith nothing
in barr or avoidance of the action aforesaid of the Said John where
upon the Said John remaineth against the Said Richard thereof un
defended therefore it is considered by the Court here that the Said
John Bailey recover against the Said Richard Bayly asweil the Said
Summe of five thousand Six hundred and thirty pounds of tobacco
his debt aforesaid as also the summe of One thousand thirty nine
pounds of tobacco more for his costs and charges in this behalfe laid
Out and expended and the Said Richard in mercy.
Garrett Vansweringen Evan Carew late of St Maries County other-
& John Quigley wise called Even Carew of St Maries County
agt in the Province of Maryland was Sumöned
Evan Carrew to answer unto Garrett Vansweringen and
John Quigley in a plea that hee render unto
them the Summe of eight hundred flinty One
pounds of tobacco which to them he oweth
and unjustly deteineth.
And whereupon the Said Garrett and John by Keneim Cheseldyn
their Attorny Say that whereas the Said Evan the third day of Octo
ber in the yeare 1672 did by his certaine writeing Obligatory Sealed
with the Seale of the Said Evan here in Court produced whose date
is the day and yeare abovewritten acknowledge himselfe to be hoiden
and firmly bounden unto Garrett Vansweringen and John Quigiey
of the Citty of St Maries in the Province of Maryland the full Sume
of foure hundred Sixty Seaven pounds of tobacco Sound and mer
chantable tobacco for accomodations received to be paid to the Said
Garrett Vansweringen and John Quigley their certaine Attorny their
heirs executors administrators or assignes or either of them con
venient in St Maries County aforesaid upon all demands to which
payment well and truly to be paid he did bind himselfe his heirs
executors administrators firmly by these presents And whereas the
Said Even the third day of December in the yeare 1672 by his cer
taine other writeing Obligatory Sealed with the Seale of the Said
Evan here in Court produced whose date is the same day and yeare
next abovewnitten acknowledge himselfe hoiden and firmly bound
unto the said Garrett Vansweringen and John Quigley of the Citty
of St Maries in the Province of Maryland in the full quantity of
foure hundred twenty foure pounds of good Sound merchantable
tobacco in caske being for accomodations already received to be paid
unto the said Garrett Vansweringen and John Quigley their heirs
