368 Provincial Court Proceedings, 1674.
Liber M M dred foure pounds of tobacco which to her he
oweth and unjustly deteineth
And whereupon the Said Margarett Penry by Keneim Cheseldyn
her Attorny Saith that whereas the Said Thomas Howell the tenth
day of October in the 43th yeare of the Dominion of Caecilius &c
Annoq Doth 1674 at Caecil County aforesaid did borrow of her the
Said Margarett the sume of One hundred and twelve thousand foure
hundred pounds of tobacco to be paid to her the Said Margarett
when thereunto required Notwithstanding which the Said Thomas
the said One hundred and twelve thousand foure hundred pounds of
tobacco to her the said Margarett though often thereunto required
hath refused to pay and Satisfie and the same to pay and Satisfie as
p. 278 yet doth deny and refuse whereupon the said Margarett Saith she is
dampnified and hath lost to the value of fifty thousand pounds of
tobacco and thereupon she produces her Suite &c.
And the aforesaid Thomas Howell in his proper person cometh
and defendeth the force and injury when &c and the Said Thomas
here in Open Court acknowledges the debt aforesaid of the said
Sume of One hundred and twelve thousand and foure hundred
pounds of tobacco by which the Said Margarett against the Said
Thomas for the Said debt of One hundred and twelve thousand and
foure hundred pounds of tobacco remaineth wholy undefended
Therefore it is considered by the Court here that the Said Margarett
recover against the Said Thomas the said Summe of One hundred
and twelve thousand and foure hundred pounds of tobacco But that
as to fifty Six thousand and two hundred pounds part of the said
tobacco that execution thereof cease until the tenth day of October
next which shall be in the yeare of Our Lord One thousand Six hun
dred Seventy five.
And the Said Margarett by Robert Ridgely her Attorny cometh
into Court and acknowledgeth her Self e Satisfied contented and paid
the Sume of twelve thousand foure hundred pounds of tobacco part
of the judgment abovesaid.
And it is here further Ordered by the consent of the parties above-
said that the Suite depending in Chancery betweene the Said Marga
rett Penny Complaint and the Said Thomas Howell and Johanna
Goldsmith defts be dismist each party paying their Owne costs.
Thomas Aron Jonathan Squire late of St Maries County
agt administratrs of the goods and Chattells of
Jonathan Squire admr John Morecroft deceased was attached to
John Morecroft. answer unto Thomas Aron in a plea of tres
pas upon the case.
And whereupon the Said Thomas by Robert Carvile his Attorny
Said that whereas the Said John in his life time to witt upon the
tenth day of November in the yeare of Our Lord One thousand Six
