Whereupon the Said Richard Speed prayed an attachment against Liber M M
the goods Chattells and Creditts of the Said Edward and Compa to
the value of One hundred and fifty pounds Sterling to be directed to
the Sheriff of St Maries and the Sheriff of Charles County respec
tively and that the Same goods Chattells and Creditts (or any
thereof So attached) to the value aforesaid might be to him delivered
and the Same is granted unto him returnable the next Provinciall
Court
October 14th
Mr Robert Carvile and Mr Keneim Cheseldyn Attornyes of this fine 800 ll
Court for non attendance upon the Court. fined four hundred pounds Tob
of tobacco apeice
Virlinda Stone It was Comanded the Sheriff of Charles County
agt that he take Edmund Lindsey if &c to answer unto
Edmund Lindseyj Virlinda Stone in a plea of takeing and unjustly
withholding of Henry Dorman her Servant.
And whereupon the Said Virlinda by John Morecroft her Attorny
Saith that the Said Edmund the first day of june in the 40th yeare
of the Dominion of Caecilius &c in Charles County tooke and him
unjustly deteined against Suertyes and pledges wherefore She Saith
She is dampnified and hath losse to the Value of three thousand
pounds of tobacco and thereupon she bringeth her Suite.
And the Said Edmund by Robert Carvile his Attorny Cometh
and defendeth the force and injury when &c and Saith he is in no
wayes guilty of the prmisses above against him by the Said Virlinda
Complained of and of this he putts himselfe upon the Country and
the Said Virlinda likewise. Therefore it is Comanded the Sheriff
that he cause to come here twelve &c by whom &c who neither &c
because aswell &c to recognize &c.
Afterwards to witt the 15th day of October in the 43th yeare of his
Lopps Dominion Came aswell the Said Virlinda Stone by Keneim
Cheseldyn her Attorny and the Said Edmund Lindsey by Robert
Carvile his Attorny as the jurors of that jury likewise Came to witt.
Richard Edlen James Nutthall, Wm Dunkerton Samuel Hatton
Henry Rider, Thomas Price, Robert Hatton, Abell James Thomas
Griffin Wm Melton Robert Morgan and Constant Daniel who to
Say the truth in the premisses being impannelled Sumoned and
Sworne. Upon their Oathes doe Say that they find for the plaintiff
twelve hundred pounds of tobacco.
Therefore it is Considered by the Court here that the Said Virlinda
Stone recover against the said Edmund Lindsey as well the Said
Sume of twelve hundred pounds of tobacco the debt aforesayd as
also the sume of One thousand and forty pounds of tobacco for her
costs and Charges in this behalf e laid Out and expended.
