162 Provincial Court Proceedings, 1673.
Liber M M John Prat Rule passed in this Cause that the Defendt pleade by
agt Munday morning or Judgt to be awarded agt him by
Tho: PhilipsJ Default; the Defendt filed his plea in time wherefore
ye Cause continued untili the next Cort.
Edmond Lister Thomas Momford late of St Maryes County
agt Marchant was attached to answere unto Edmond
Thomas Momfordj Lister gentt wherefore by force and Armes One
Island called the ff olly conteyning five hundred and fifty acres of
land in County wch William Thomas to the said Edmond
did Demise for a Terme wch is not yet paste did Enter and him the
said Edmond from his farme aforesayd did Eject and other Enormi
p. 99 tyes to him did there doe to the greate Damage of him the said
Edmond and Contrary to the peace &c
And whereupon the said Edmond by John Morecroft his Attorney
complaineth that whereas the said William Thomas the sixth day of
July in the fortieth yeare of the Dominion of Caecilius &c Annoq
Domini 1672 had Demised to the said Edmond the Tenemts afore
sayd with the appurtenances to have and to hould to the said Edmond
& his assignes from the ffeaste of St Michael the Arch Angell laste
paste to the ende Terme of five yeares from thence next ensueing
fully to be compleate and Ended by vertu of wch Demise the said
Edmond into the Tenemts aforesayd with the apptnces did Enter
and was thereof possessed and so thereof being possessed the said
Thomas Momford afterwards to wit the said sixth day of July in
the 40th yeare of the Dominion of Caecilius &c aforesayd into the
Tenemts aforesayd with the apptnces wch the said William to the
said Edmond informe aforesayd had Demised for the Terme afore
sayd wch is not yet paste with force and armes and did Enter and
him the said Edmond from his farme aforesd did Eject and other
Enormityes to him did there doe to the greate damage of him the said
Edmond and Contrary to the peace &c whereupon he saith he hath
damage and is the worse to the vallue of Tenne pounds sterling,
and thereupon he bringeth his suite.
And the said Thomas Mom ford by Kenelm Chiseldine his At
torney comes and Defends the force and injury when &c and the
said Thomas prayeth Delay thereof untill the first day of the next
Cort, and the same day is given to both ptyes.
At day that is to say the Eighth day of Aprill in the 41th yeare
of the Dominion of Caecilius &c Annoq Domini 1673. It is by the
Cort ordered by consent of John Morecroft Attorney of the plt and
Keneim Chiseldine Attorney for Philip Shapleigh late of Somrset
County gentt that the said Philip shalbe admitted defendt who shall
appeare without Delay by his Attorney aforesayd and shall Receive
a Declaration and pleade the genrall issue thereunto this Cort and
to the tryall thereof shall appeare in his pp pson or by his Councell
