Provincial Court Proceedings, 1673. 127 of Kent, fforte, Lyeing in Kent County in the said Province of Liber M M maryland with all houses Leases Lands Tenemts & hereditants to the same belonging & in the same Indenture of Bargaine & sale menconed with their Appurtenes, Without any Condition Lymitacon or Pro visoe therein Conteyned but in absolute fee simple To him the said Richard Moy his heyres and assignes, Now This Indenture further wittnesseth That if the said John ffitzherbert & mary his Wife or the sayd Edward ffitzherbert or any of them their or any of their heyres Exrs Admrs or assignes or any of them shall & doe well & truely from tyme to tyme and at all tymes hereafter save and keepe harmless and sufficiently Acquitt and discharge the said Richard Moy his heyres Exrs Admrs and eury of them and all his & their goods & Chattells Lands and Tenemts & eur pt and pcell of them of & from & against all persons whatsoeur of & for Entring into the said Bond by them the said Edward ffitzherbert John ffitzherbert, & Richard moy to them the said Caleb Baker, Garret Vansweringen & waiter Waterling. & of & for all Accons suites Costs Troubles demands Or Damages whatsoeur by Reason of the prmisses or any part p. 65 thereof, That then & from thenceforth the sayd Recited Indenture of Bargaine & sale made of the said Mannor & prmisses shalbe Utterly Voyd and of none Effect, And the said John ffitzherbert and mary his wife shall haue agayne and Reposesse the same as in their iformer Right Any thing hereafter to be done by the said Richard moy or any Claymeing by from or under him to the Contrary thereof in any wise notwithstanding, In Testimony wherof the said Richard Moy hath hereunto sett his hand & seale the day and yeare first aboue written Sealed & Deliured in the Rich: Moy—sealed prsence of G Vansweringen John Baker Ro: Carvile This bill bindeth me Thomas Ball of the County of Somrset in the Province of maryland planter me my heyres Executors Administra tors or assignes to pay or cause to be paid unto mr Richard Covill of London marrinor to his Exrs Adminrs or assignes the full & lust Quantity of Three Thowsand Two hundred pounds of good sound bright & large Arronoca Tobacco. cleare of all ground leaves & Trash Tobacco. with Casque to Conteine the same, to be paid at some Convenient place in wiccacomika Riur upon the Tenth of Octo ber next ensueing the date hereof wittnesse my hand & seale the Twenty first of Aprill in the yeare of our Lord god. 1673.
