commanding him to impanel and return a Jury of the most substantial
freeholders not less than twelve Inhabitants within the said County
to be and appear before the said Commissioners at the said Town of
Baltimore upon a certain Day to be by them limitted and appointed
which Jury upon their Oath to be by the said Commissioners or the
Major Part of them to the said Jurors administred shall enquire who
is or are the Owner or Owners of the said Land what is the Value
thereof and what Damages such Owner or Owners will sustain And

the sum of Money the said Jurors shall assess to the Owner or Own-
ers of such Land for such Land and Damages shall be paid by the
said Commissioners and the Payment for the Land as aforesaid shall
invest the Justices of Baltimore County and their Successors with
an Estate in fee simple for the Use of the County aforesaid for ever

be paid by

sioners.]

And the said Commissioners or the major Part of them are hereby
authorized and impowered to cause the said Part of the said Street
and the said Land adjoining to be laid out by the Surveyor of the
said County with good and sufficient Boundaries and a Certificate
thereof to be returned and recorded in the County Records and to
treat and agree with Undertakers or Workmen to build and finish
a Court House and Publick Prison with a good Yard and other
Conveniences thereto on such Land as aforesaid

And Whereas for defraying Part of the Expence and Charge of
Purchasing the said Land and building the Court House and Prison
thereon sundry Inhabitants of the said County have subscribed con-
siderable sums of Money

Be it Enacted That the said Commissioners or the Major Part of
them shall and they are hereby impowered to receive and collect all
Monies by the said Persons Subscribed And such Subscribers are
hereby directed to pay their several Subscriptions to the said Com-
missioners And if any Person shall neglect or refuse to pay such his
Subscription Money the said Commissioners or the Major Part of
them may and they are hereby authorized to recover and receive
the same

And be it further Enacted That the Justices of Baltimore County
Court shall and they are hereby authorized directed and impowered
to assess and levy on the Taxable Inhabitants of the said County
at the Time of laying the Publick Levy a Quantity of Tobacco not
exceeding three hundred thousand Pounds of Tobacco by two equal
Assessments in the Years seventeen hundred and sixty Eight and
seventeen hundred and sixty nine together with the Sheriffs Sallary
of five per Cent for Collection which said Assessments so as afore-
said to be made and levied shall be collected by the Sheriff of the
said County from the several Taxable Persons who shall reside
within the said County in the same manner as other publick and
County Levies are by Law collected And the said Tobacco when so
as aforesaid collected shall be paid by such Sheriff to the said Com-
