612 Charles County Court Proceedings, 1674. Liber F County in the Province of Maryland doe owe & stand indebted unto John Wood of the same County & Province in the full & just sume of foure hundred pounds of good sound Merchantable leafe tobacco & Caske to be paid unto the sd John Wood his heires Execrs Admrs or Assignes at or upon the tenth day of Octobr next ensueinge the date hereof at some Convenient place in Portobacco Creeke, to which payment well & truely to be made & done I binde myself e my heires Exects & Admrs firmely by these presents, In Wittnesse whereof I have hereunto sett my hand & seale. Thomas Witter Signed sealed in the presence of (locus) sigilli John Stone Samuell Walter Whereupon the plaintife John Wood obteined a judgment p order of Court against the Defendant Thomas Witter for the suffie of foure hundred pounds of tobacco with Cost of suite Bill of Costs tb tobacco To Atturneyes Fees 200 To Samuell Walter 2 dayes Attendance 060 Sume 260 In a Cause depending betweene Samuell Snead plaintife & John Oliver Defendant, It is ordered by the worshipfull the Comissioners that the action be dismist. In a Cause depending betweene Benjamin Rozer plaintife & John Allen Admr of all & singular the goods & Chattles of Nicholas Solby dec Defendant John Allen Administratr of all & singular the goods & Chattles of Nicholas Solby dec was Attached to Answer unto Benjamin Rozer of a plea that hee render unto him two thousand pounds of tobacco which hee unjustly deteineth. Whereupon the sd Benjamin in his propor person saith, that whereas the aforesd Nicholas in his life on the fifth day of Novembr 1673 by his certaine writeing obligatory sealed with his seale, [p.35] which the Benjamin bringeth here in Court, Did acknowledge himselfe to owe & stand justly indebted unto the sd Benjamin the full & just quantity of two thousand pounds of tobacco & Caske to be paid unto the Benjamin his heires &c at or before the tenth day of Octobr then next ensueinge, And to the same payment well & truely to be made the aforesd Nicholas did binde himself e his heires Execrs & Admrs by the same bill Yett neither the aforesd Nicholas in his life time, nor the John to whom Administracon of all & singular the goods & Chattles which were of the sd Nicholas at the time of his death was Comitted although often demanded, the aforesd 2000 lb of tobacco have not rendred to the sd Benjamin & the sd John to render doth deny & unjustly deteine, whereupon hee |
