584 Charles County Court Proceedings, 1674. Liber F In a Cause depending between John Hartwell plaintiffe & William Taylor Defendt William Taylor was Attached to Answer to John Hartwell of a plea tht hee rendr unto him eight hundred pounds of Tobaccoe & Caske which hee unjustly deteineth And the sd John Hariwell (by his Atturney John Jones) sayth that whereas the sd William Taylor by his certaine Writting obliga- tory under his hand & seale, dated the 27th day of June (1674) is held & firmely bound unto him the sd John his certaine Atturney [p.8] executrs Admrs & Assignes in the sume of eight hundred pounds of tobaccoe & Caske to be paid upon demand at some Convenient land- ing at Portobaccoe Creeke in the County abovesd which sd writting is here ready to be produced in Court, And whereas the sd John hath often demanded the sd sume of 800 lb tobaccoe & Caske of him the sd William, hee the sd William hath & doth neglect to pay the same according to the tenour of the sd Writtinge, Whereupon hee sayth hee is damnified & hath losse twelve hundred pounds of tobaccoe, And brings his suite &c. Whereupon the plaintiffe produces this followeing bill Know all men by these presents tht I William Taylor of Charles County in the Province of Maryland planter am holden & firmely bound unto John Hartwell of the County & Province aforesd Merchant taylor or to his certaine Atturney his heires Execrs Admrs & Assignes the full & just sume of Eight hundred pounds of good sound Merchantable leafe tobaccoe & Caske to be paid upon demand at some Convenient Landing place at Portobaccoe Creeke in the County & Province aforesd for which paymt well & truely to be made I bind myselfe my heires Execrs Admrs firmely by these presents as Wittnesse my hand & seale this 27 day of June (1674) Signed sealed & delivered his marke in the presence of Willm X Taylor John Clements: Alexander Lowrie Whereupon the Worship full the Comissionrs ordered a judgement against the sd William Taylor defendt for the sd sume of Eight hundred pounds of tobacco with Cost of suite to the sd John Hart- well plaintiffe Bill of costs Entred.
