Charles County Court Proceedings, 1671—1674. 517 William Boyden acknowledgeth that he hath in his hands nine Liber E hundred & fiftie pounds of tobacco of the Estate of Henery Johnson payable next yeare which is attacht by Phillip Lynes accordinge to an order granted him this Court. In a difference dependinge betweene John Wood Plaintiff & John [p. 145] Allen Defdt Admr to Nicholas Solby Dec the Defendt pleaded that he had not Administred & besides that he would not appeare to answer the difference in this Court, whereupon a nonsuite was granted agst the Plt: However the Plaintiff proved his debt due by bill by the testymonie of Augustine Peters who swore that his name affixed to the bill was his owne writinge & that he saw Nicholas Solby signe the said bill & seale it & deliver it unto John Woods, & that James Liewellin was then present & signed the testimony of the said bill with his owne name, which James Liewellin also acknowledged, which bill is dated the 25 december 1672 and is in this manner for two thousand pounds of tobacco in Cask due to be paide upon the tenn day of October next ensueinge in some convenient place in the sd County, After this said paymt the sd Nicholas Solbye oblige himself e his heires executrs admrs & ass to deliver to the Defdt his heires executrs admrs & asg One man servant at Christmas after the sd tobacco payment ensueinge, And the sd Servant to be at satifaction of the sd John Wood for the which paymt to be well & truly made & the delivinge of the sd man Servant he layd my hand & seale the day of the date above written. In a difference dependinge betweene William Barton Senr Plaintiff and Thomas Hussey Defdt it beinge a cause referred from the last Court, the Plaintiffe declared that the Defdt assumed to pay unto him two thousand fower hundred & fower pounds of tobacco due to him by two seVall bills from Michaell Ashford, & the Defdt pleaded he did not assume the sd payment, which Cause is respited to be tryed next Court, because the Plts Evidence could not be present, beinge prevented by sicknes & very cold wett weather. In a difference dependinge betweene Benjamin Whitchcott Plt & Robert Cady Defdt the Plt appeares by his Attorney Mathew Hill & the Defdt by his Attorney Samuell Cressey, the cause is dismist for want of Evidence to the Plaintiffs tre of Attorney. In a difference dependinge betweene Mathew Hill Plaintiffe & Robert Cady Defdt, the Plaintiff declares for one hundred pounds of tobacco for marryinge of the Defdt accordinge to Act of Assembly unto Elizabeth his now wife, the Defdt by his Attorney Samuell Cressey pleaded that the Plaintiffe ought not to have his action agst the Defdt but was utterly barred by the Act of assembly made Anno 1669 intituled an Act for limittacon of certayne actions for avoyd |
