368 Charles County Court Proceedings, 1671—1674. Liber E whereupon the Court gave order agst the deft for the Said Sume of Six hundred & Sixty pounds of tobaccoe wth Costs of Suite as in the Ensueing bill To Atturneys Fees 6o To coming goeing & attendance att Court 90 150 Tho: warner being attached to answer to Jno prior Came & appeared to answer the Suite Comenced agt him. Likewise Jno prior came & appeared by his Atturney Sath Cressey, to prosecute his Suite Comenced as above. whereupon the Sd Sath Cressey pduced this Ensueing Lre of Atturny. Know all men by these pnts that I John pryor of Charles County planter have & by these pnts doe Constitute ordaine & appoint Sam: Cressey of the Same County my true & lawfull Atturny for me & in my name & to his owne pper use & behoof to aske levy recover & receive of Thomas warner of Charles County the Sume of Six hundred and twenty pounds of tobaccoe due to me by bill from the Said Thomas warner Bearing date the 9th day of January 1670, Giving & by these pnts granting unto my Said Atturney my full power & Authority to act & doe in & for the recovery of the premises as far forth as the Law will pmitt or I might doe if personally prsent Likewise one or more Atturnys to make & at pleasure to revoke Ratifying & by these pnts allowing for firme & Stable what- soever my Said Atturney or his Substitutes shall doe or Cause to be done in the premises as if done by myself e or I were there Psonally prsent In wittnes whereof I have hereunto Sett my hand & Seale this 2d day of march Anno Domini 1671/2 Signed Sealed & Dellivered John pryor (locus in prsence of us Sigilli) Philip Gibbon Hump: Warren who both testifyed in open Court this to be the act & deed of John pryor. wherefore the plts Atturny Sa: Cressey Complained agst the Deft for that whereas the Said deft by the before menconed bill bearing date the 9th day of Janry 1670 aforesaid became bound to pay to the plt the Said Sume of 620th tobaccoe upon demand yet never- theles the Said Deft although often thereto required the Said Sume according to the tenor of the Said bill hath not Satisfyed but doth altogether refuse to pay the Same whereupon the plt Saith he is Damnifyed & hath lost to the vallew of 800 lb tobaccoe & thereupon he bringeth his Suite. And produced this Ensueing bill in Court to be read. This bill bindeth me Thomas warner my heires Execrs & Admrs to pay or Cause to be payd unto John pryor his heires or assignes |
