Charles County Court Proceedings, 1671—1674. 329 Sath: Price by his Atturney Rich: Boughton Came & appeared to Liber E prosecute his Suite Comenced agt Ed: Madock who by his Atturney [fol. 41] Richard Edelen came & appeared to defend the Same. whereupon the plt preferred his declaracon wch was Read in Court to the Effect as foll: The plt Complaineth agt the Deft for that whereas the Deft for that whereas on the 6th of Janry last past or thereabouts the Sd plt did Employ him the sd deft in looking after a Runaway Servant belonging to him the Sd Plt who had at that time absented himselfe from his Service in Consideracon whereof the Said plt did then assume on himselfe & to the Sd Deft did promise that he would pay to the Sd Deft the Sume of foure hundred pounds of tobaccoe which nevertheles the Sd Defendt although often thereunto required hath not Satisfyed but doth altogether refuse to pay the Same to the Sd Plts Damage the Sume of 600 lb of tob & thereupon he bringeth his Suite. Whereupon after many alligations by the Atturnys on Either Side the Sd Plt having proved his declaration the Court gave Judgemt agt the Deft for the Sume of foure hundred pounds of tobaccoe with Costs of Suite: whereupon the plt preferred this Ensueing bill of Costs which was allowed him: lb Tob: To Atturnys Fees 060 To the Said Sath price for his owne Coming goeing & attend on the Court 3 days att 30 lb p diem 090 To Tho: Steele & his wife for Evidence charge for att 2 240 Courts 2 days Each Court att 30 p diem To John ward for 3 days att: at Court at 30th p diem.... 090 480 Upon a Reference granted the last Court in a certain matter of difference depending between James Smaliwood Plt: & Martha Lewgar Admrx of the Goods Chattells & Creditts of John Lewgar deed in a plea of debt. The plt preferred his declaracon as foll: The Said James Complaineth agt the sd Martha for that whereas the Said John Lewgar in his life time on the tenth day of october in the xxxviith yeare of the Dominion of Caecilius Annoq Domini 1668 by a certain writing under the Seale of him the Said John did become bound unto the Said James to pay unto him the Sume of foure hundred & ten pounds of tobaccoe & Caske when thereunto required Notwithstanding the Said John in his life time nor the Said Martha as Administratrix of his Goods & Chattells since his death the Said Sume of 410 lb of tobaccoe to him the Said James although often thereunto required hath not Satisfyed but doth altogether refuse |
