236 Charles County Court Proceedings, 1668—16 70.
Liber D 1668 in the xxxviith yeare of the Dominion of Caecilius &c had &
received from the Said Edmond divers parcells & quantitys of Drinke
& other ordinary accomodacons a particular accot whereof is here
in Court by the Said Edmond produced amounting to the Sume of
foure hundred ninety Eight pounds of tobaccoe the Said william did
in Consideracon thereof then assume on himselfe & to the Said
Edmond did faithfully promise tht he the sd Willm the Sd Sume of
498th of tobaccoe to the Said Edmond when thereunto required
would well & truly Satisfy & pay Notwithstanding the Said william
his promise & assumption little minding or regarding but devising &
frawdulently intending him the Said Edmond the Said Sume of
498th Tobaccoe to deceive the Said Sume of 498 lb of tobaccoe to
him the Said Edmond hath not Satisfyed but Doth altogether
refuse to pay the Same whereupon the Said Edmond Saith he is
damnified & hath Loss to the vallew of 8ooth of tobaccoe & thereupon
he bringeth his Suite &c, And withall the plt produced a particular
accöt of the Severall goods before menconed which the deft putting
him to the proofe of.
Ralph Coates Subpa in the behalf e of the plt Sworne & Examined
Saith that he with his owne hands delivered severall parcells of
drinke & other goods to the deft as is abovespecified
Whereupon the Deft alleaging that the plt had Killed a steere of
his the Sd Defts & had not given him any accot thereof whereupon
the plt Compounded with the Sd Deft to allow him the Sd Deft for
the Said Steere the Sume of 325 lb of Tobaccoe & the Deft Con-
fesseth a Judgemt for 173 lb of tobaccoe being the rema of the Said
498 lb of tobaccoe & the plt requesting it was allowed Sixty pounds
of tobaccoe for his two days attendance on the Court.
Rich: Fowkes being Attached to answer to Edmond Lendsey in a
plea of trespasse upon the Case for the Sume of One hundred twenty
Fight pounds of tohaccoe the accot having been first proved by the
oathes of Edmond Lendsey & Ralph Coates by his Atturney Con-
fesseth Judgement for the Said Sume of 128 lb of Tobacco wth Costs
of Suite the plt was allowed ninety pounds of tobacco for his owne &
Evidences charges
Richard Boughton being Attached to answer to the Said Edmond
Lendsey In a plea of trespasse upon the Case for the Sume of One
thousand Six hundred forty & two pounds of Tobaccoe Confesseth
a Judgemt to the Said Edmond Lendsey for the Said sume of 1642th
tobaccoe with Costs of Suite.
Jacob Leak being Attached' to answer to the Sd Edmond Lendsey
in an accon of trespasse upon the Case amounting to the Sume of
Seventy Eight pounds of tobaccoe the accot being first proved by
the oathes of the Said Edmond Lendsey & Ralph Coates Confesseth a
