232 Charles County Court Proceedings, 1668—1670.
Liber D Anne Fowke by her Atturney Capt Josias Fendall made her ap-
pearance to answer the Suite Comenced against her as aforesaid,
whereupon the Sd plts declaracon was read in Court to the Effect
as foll: vizt
The Said Thomas Alcock complaineth against the Said Anne
Fowke for tht whereas the Said Thomas at the Speciall instance &
request of the abovesd Gerard Some time in may & June Anno Domi
1669 & the 38th yeare of the Dominion of Caecilius &c did build
Sett up, & finish, for the Said Gerrard one Syder mill & presse, in
Consideracon whereof the Said Gerrard did assume on himself e &
faithfully promise to the Sd Thomas, that he the Sd Gerrard would
pay unto the Said Thomas the Just quantity of Two thousand
pounds of tobaccoe when thereunto he Should be required, Not-
withstanding the Said Gerrard in his life time, nor the Said Anne
Administratrix of his goods & chattells Since his death, though
often thereto requested hath not payd or Satisfyed the Said Sume
of 2000 lb of Tobaccoe but doth altogether refuse to pay the Said
Sume to great damage of the Said Thomas whereupon he Saith he is
dampnified & hath loss to the vallew of 2500th tobaccoe & thereupon
he Bringeth his Suite
whereupon the Defts Atturney requiring it the plt produced
George Godfrey who Subpad Sworne & Examined in open Court
Saith That the before named Gerrard Fowke agreed with the Sd
Thomas Alcocks to build the Said mill & presse & for the doeing of
the Same was to pay unto him the Sume of 2000 lb tobaccoe Where-
upon it was ordered that the Said Anne Fowkes Should pay unto
the Said Thomas Alcocks the Said Sume of 2000 lb of Tobaccoe
with Costs of Suite & the plt preferred this Ensueing bill of Costs.

George Thompson Came & acknowledged a Judgement to Robert
perce Chyrurgion for the Sume of 32000 lb of Tobaccoe to be payd
on the 10th day of november Anno Domi 1670
Philip Cary plt by his Atturney Garratt Hammond came &
appeared to prosecute the Suite by him Comenced against Daniel
Mathena in an accon of trespasse on the Case. the Deft Entered
Rich Boughton his Atturney.
Daniel Mathena Likewise appeared to answer to the Suite of
philip Cary as aforesaid, whereupon the plts Declaracon was read
in Court to the Effect as foll viz:
