        Liber D    utter'd as aforesd & where it shall appeare to this Worfull Court tht
              in reference to any speciall & pticular words of the sd slanderous words
              the sd Richd hath not as yet been actually damnified the sd Nicho:
              may give in sufficent security to the sd Rich: to satisfy him for wt
              Damage & Detrimt may & in all probability is likely to Come on the
              sd Rich: by reason of the sd slanderous words

                The Court thinks it not necessary Emanson should give security
              to the plt since noe visible Damage appeares, where upon they
              grant'd execution agt the plt Rich: Boughton, wth Cost & charges
              of Suite.

              Nicholas Emanson Plt     In a plea of Trepasse
         Rich: Boughton Deft     upon the Case
                And where upon the sd Nicholas Complaineth agt the sd Rich:
              Boughton, tht is to say tht whereas the sd Nichol: in the month of
              March in the three & thirtieth yeane of the Dominion of Caecilius
              &c, at the Instance & request of him the sd Rich: & at divers &
              sundry othr times since hath sold & ttd unto the sd Richd diverse
              parcells of Drink, & othr ordinary Accomodacons & necessarys amting
              to in the whole to 2703th Tobacco wch sd sume of 2703 lb of Tobacco
              the sd Rich: did Assume upon himself & to the sd Nicho: did faith-
              full pmise tht he the sd Richd the abovesd Quantity of 2703th Tobacco
              well & truly would satisfy & pay unto the sd Nicho: wn there unto
              required, Notwithstanding the sd Richd though often thereunto re-
              quested hath not satisfied nor any wise Contented the sd Nicho: for
              the same but altogether refuseth to satisfie the same where upon the
              sd Nicho: saith he is Damnified & hath loss to the valew of 3000 lb
              Tobacco & thereupon he bringeth his suite.

                The Court grants a Judgmt agt the Deft for 2703 lb Tobacco &
              Charges.

                Robt Downes of Charles County was attached to answer unto John
              Chaireman in a plea wherefore by force of Arms the Close of him
              the gd John at Nongemie on the north side of Avon river did breake
              & othr inormities to him there did doe to the great Damage of him
              the sd John & Contrary to the peace of the ld Proprietary of this
              pvince, And where upon John Compt wherefore whereas the sd Robt
              somtime in Janury in the xxxviii yeare of the Dominion of Caecilius
