138 Charles County Court Proceedings, 1668—1670. Liber C Robert Sampson Plaintife Came and made his Personall appear- ance this Court to Prosecute the suite Commenced by him against William Thomas Defendt in a Plea of Detinue William Thomas Defendt made his personall appearance to Defend the said Suite Commenced against him by the said Robert Sampson as aforesaid Whereupon the Plaintifes Declaracon was read in as fol- loweth (vizt) To the Worple the Comissionrs of Charles Countie. Robert Sampson Plaintife William Thomas Deft In a Plea of Detinue Whereupon the said Robert Complaineth agt the said William For tht tht is to Say That Whereas one Robert Humphreys became indebted unto the said William in the Summe of 2800 lb of tobaccoe for the true Payment of wch the said Robert Humphreys gave Bill to the said William; And Likewise Whereas [Continued in next liber.] Liber D the said Robert the Plaintife did for a valueable Consideracon all- [P. 1] readie Receaved by the said William Purchase of him the said William all his right, title, and interest in the said Bill passed to him for the said 2800 lb of tobaccoe by the said Robert Humphreys as aforesaid, & the said William the Defendt did Likewise make firme Assignment of his title in the said Bill by Writing signed sealed and Delivered by him unto the said Robert in the Presence of Edmond Roberts and John Selbee; yet Notwithstanding his said Assignment he refuseth to Deliver the said Bill to the said Robert as of Right he ought to doe but hath detained the same and doth still detaine the same Whereupon he brings his Suite. Hereupon the Defendt entered William Calvert Esq his At- torney in this action allsoe who Pleaded tht Whereas It did appeare by expresse words in the Declaracon tht the Bill for wch the Plain- tife sued was Delivered t& the Plaintife before Witnes he did Desire order of Nonsuite agt the Plaintife and the Plaintifes At- torney Henrie Neale making noe Sufficient Replie to the said Plea, as not specifleing whether the Assignment in the Declaracon Men- tioned were endorsed on the back of the Bill, or were a distinct and severall writing and Instrument of itselfe It was Therefore Ordered That the Plaintife be Nonsuited and Pay Costs of suite Walter Peake of St Maries Countie Plaintife versus Miles Chaffe and William Sturdivant Defendth in a Plea of Debt to the value of 795 lb of tobaccoe; Damages to the value of [blank] Writt to the Sherrife Retornable on the 11th Day of August 1668.
