Charles County Court Proceedings, 1666—1668. 135 to the said Daniel the said Summe of 378 lb of tobaccoe though the Liber C same hath been frequentlie demanded of him hath not Satisfied or in anie Manner for the same Contented and Paid unto the Daniel But alltogether doth refuse to doe the same Whereupon the said Daniel Saith he is Damnified, & is the worse for 400 lb of tobaccoe, & thereupon he brings his suite. Whereupon the said Thomas did Acknowledg a Judgmt to the said Daniel for the said Summe Ordered Therefore That the Defendt Pay unto the Plaintife the just quantitie of 378 lb of tobaccoe together wth Costs of suite Robert Sampson Plaintife made his Personall appearance this Crt to Prosecute the Suite Commenced by him against William Thomas Defendt in a Plea of trespasse upon the case. William Thomas Defendt made his personall appearance to Defend the said Suite Commenced against him by the said Robert Sampson as aforesaid. Whereupon the Plaintifes Declaracon was read in Crt as followeth vizt To the Worple the Comissionrs of Charles Countie. Robert Sampson Plaintife Will. Thomas Defendt In a Plea of trespasse upon the case. Whereupon the said Robert Complaineth agt the said William For tht tht is to Say That Whereas the said Robert Sundrie and Severall times did at the instance and request of the said William Sell and Deliver to him 2 Caskes of Cyder for 800 lb of tobaccoe, one caske of vinegar for 250 lb of tobaccoe 70 lb of Sugar at 5 lb of tobaccoe p pound for 350th of tobaccoe and two paire of Stockins for 100th of tobaccoe all which said Severall Summes amounting in the whole to 1500 lb the said William did assume upon himselfe and faithfullie promise That he the said William the same to the said Robert well & truelie would Satisfie and Pay when thereunto required Notwith- standing the said William the said Severall Summes amounting to 1500 lb of tobaccoe aforesaid though often thereunto required hath not Satisfied or in anie wise for the same Contented and Paid, but hath refused to doe the same and doth still refuse to the Dammage of the said Robert and thereupon he brings his suite. The Defendt hereupon Entered William Calvert Esq his Attorney who Pleaded That the Plaintife accepted a Letter of Attorney tendered & delivered to him by the Defendt, endorsed wth firme Assignment of the same, in Satisfacon of the said 1500 lb of tobaccoe specified in the Declaracon, wch Lettr of Attorney was made by one Henrie Walker to the Defendt empowering him to sue for 1200 lb of tobaccoe due from Owen Jones to the said Henry, and was as followeth (vizt) |
