The Humble petition of sundry the Inhabitants Freeholders and
Free Voters in the Corporation of the City of Annapolis
Sheweth
That a Writ of Election lately Issued in the usual Form directed
to the Mayor Recorder and Aldermen of the said City requiring
and impowering them to proceed in the Choice of Delegates in the
Room of Mr Walter Dulany who had disqualified himself by
accepting a place under the Government since the last General Election
that on the fifth Day of October last past the Day appointed for the
said Election there were present the said Walter Dulany as Mayor
of the Corporation aforesaid together with five of the Aldermen of
the said City and the said Walter Dulany and John Hall were then
proposed as Candidates the Honourable Daniel Dulany Esq.r
Recorder being absent
And your petitioners further shew that the said Walter Dulany
sat and Acted as Mayor during the whole Time of the said Election
and did not withdraw himself from the Bench on any Controversy
about the Qualification of the Electors but objected in his Seat to
the Qualifications of such as Offered to vote against him and
continued in his Seat as Mayor at all Times during such Contro-
versies And your petitioners apprehending that the said Conduct
of the Mayor aforesaid to be unconstitutional and Illegal did object
thereto but being overruled by the Court caused the same to be
entered upon the poll And although the said Walter Dulany had
the Majority of Votes yet your petitioners apprehend the said Elec-
tion and the Return thereof to be void in itself and tending to destroy
the Freedom necessary to be observed at all Elections Your petitioners
therefore humbly pray that your Honours would take the premises
into Consideration and do therein what to Justice doth belong
And as in Duty bound will ever pray &c
