               Provincial Court Proceedings, 1666.     73

       That stephen Clifton was Engaged to Tho: Mountford in the Liber FF
     sume of fourteene hundred and fourteene pounds of tobacco as secur-
     ity for Demetrius Cartwright, and the said Mount ford hath recou-
     ered the said debt of yor petr ,Therefore yor petr craueth Order agst
     the said Cartwright for the sd debt wth Cost of Suite, And yor pett
     shall pray
     Tho: Bowdle Administrator The deft Craues an appeale to the Pro-
       of Stephen Clifton ptt uinall Court which is granted
     Demetrius Cartwright deft   True Coppy Jno Turuil

       Mary Veitch aged 26 yeares or thereabouts Sworne and Examined [p. 312]
     saith
       That about 4 months before Stephen Cliftons death yor depont
     was at the howse of the said Clifton and heard him say seuerall times
     that the said Clifton had giuen Demetrius Cartwright the hhd of ton:
     which he owed to Thomas Mountfort, and that he would take in
     Demetrius Cartwrights bill and that should not be all hee would giue
     the said Cartwright, for he did intend to gratifye him otherwise,
     and further saith that the hhd of tobacco was paid to the said Cart-
     wright for making him a booke of figures and giuing him instruc-
     cons in his practice, and further yor depont saith that afterwards she
     heard the said Clifton say that he had taken in Demetrius Cartwrights
     Bill from Mr Sprigg being Attorney of the said Mountfort, And
     further yor dept saith not      marke

         2d Aprill 1666

     Demetrius Cartwright The Bill the plt: past & wch the deft sues
       plt uppon Appeale uppon being produc'd is found Cancell'd
     Tho Bowdel Administr of and more Ouer that the said debt (as pre
       Step: Clifton defendt tended by the deft to belong to the Estate
     of Stephen Clifton) being not brought into the Inuentery of the said
     Estate of Step: Clifton, was iookt uppon as not suable being Can-
     cell'd by the Clke of Caluert County Court Whereupon the said Cart-
     wright as defendt in the County Court Craues Nonsuite, which was
     granted his bill of Charges being The Sume of 930 lb tobaccoe

     To the Honble the Gouernor & Councell In Prouinciall Cort Assembled [p. 313]
       The humble petn of Wm Smyth Sheweth
       That yor pett this Court Obtayned Judgmt for the sume of Thirety
     Thowsand pounds of tobacco agst wm Price his whole Estate both
     reall & personall being bound ouer for the true performance of the
     same
       Wherefore yor pett humbly prayeth that an Elegit may be granted
     him agst the lands Goods and Chattles of the said Wm Price to be
     deliuered by an Extent And he shall euer pray &c:
