Provincial Court Proceedings, 1668. 365 writt by which the said Toby Weels was first arrested and a true Liber FF Copy of the declaracon that were first filed agt him & that went out wth the aforesaid Originall writt, as alsoe a true Copy of the writt by which his Body was first taken into Execucon for or upon the said debt, the which they are to Certify undr theire hands and seales to the Justices of the next Prouinall Court to be holden att St Marys the ninth day of February next Edmund Lindsey plt morecroft p quer Resplted till tomorrow [p. 665] Thomas Sprigg deft Caluert p deft Jmorning The Court adjournes till tomorrow morning The Justices all mett as yesterday except Ba: Brook Esqr this being the iith December 1668 Ordered by the Justices of this Prouinall Court That from hence forward Whosoeuer shall att any time preferre to the Justices of this Court any Bill of Cost agt any person that shall exceed in any one perticuler the Customary Cost or Usuall allowance that is giuen by this Court shall loose the whole Cost that shall bee exprest or demanded in the said Bill upon that one perticuler Suite by which the same shall accrue John Hunt plaintiffe morecroft p quer Rob: Chisick the Admt Rozer p defendt of Jno Startup defendt This Cause resplted from last Court to this when the defendt was Ordered to giue in an Accompt of his Admcon upon the said Startups Estate But hee not performing the said Order, hauing fled the Prou- ince as was inform'd to the Court, Therefore Ordred that the plt haue his remedy against the Security of the defendts for his true performance of his said Admcon John Quigley plt: Rozer p quer Tho: Couant defendt Nottley p deft This Cause resplted from the beginning of the Court, and the defendt now enters his plea (uizt) And the said Thomas Couant by Thomas Nottley his Attorny Comes and defends the force and Injury when &c: and saith that hee did not assume & promise as the said John in his declaracon aboue alleadgeth and this hee prayes may bee Inquired of by the Country and the said John in like manner therefore Comand is giuen to the sher: &c Nottley for the defendt Neither the plt appearing nor his wittnesses to informe his Attorny Benjamin Rozer, doth suffer a Nonsuite |
