118 Provincial Court Proceedings, 1666. Liber FF Thomas Sprigg Complaint Alleadg'd by both parties that it is put Thomas Taylor defendant to Arbitracon--The deft then Craues Wm Caluert p quer Ordr for Cost upon his necepiatr by him Jno morecroft p deft entred for that the Comptt: flied not his Bill according to the Ordr of last Prouinciall Court which Cost by the Board was allowed being in the whole One hundred and Eighty pounds of tobacco Thomas Ringould prt. This Cause resplted from last Prouinall Thomas Hinson and Court and now Ordred the Surueyr Gen- Henry Parker defendts erail doe giue in his Report tomorrow Wm Caluert & John morning concerning the laying out of the Morecroft p que?. lands now in dispute—Which Report is as Daniel Jenifer p deft followeth The Order of Court by Mutuall Consent was not fuilfilled, a Jury being found unnecessary but was proceeded, the assistance of William Cowrsey gent in laying out the bounds according to the intention of the first suruey as more fully appeares by the Certificate and Plott deliuered by mee Jerome White Surueyr Generall Some differences ariseing concerning the said surueyr Generalls report and all parties not agreeing therunto, the Board doth Order that this cause be againe resplted to the next Prouinciall Court, and further Ordred that care be taken in the Choosing twelue men of a Jury of the Neighbourhood who are hereby also ordred to goe wth and informe the surueyr Generail or his deputy the naturall bounds of each parcell of land menconed in each pattent, According to the former Order granted to be fullfilled in euery respect the lines mentioned in the said pattents, The said Thomas Ringould & Thom: [p. 3821 Hinson hauing liberty to choose 12 men a peece And prsent them to the surueyr Generall or his deputy wherof he is to pick out of each an equali number for that appointed Jury and to appoint his said deputy or goe wth them himselfe to the end that a true suruey may be made and plotts drawne faire and a Report giuen undr the surueyrs hand, and sent downe to the next Prouinciall Court to be holden the day of December next and that the sherriffe giue his attendance on the Jury after they come together and Warned in by him After which came into Court both plt and deft & deliuers in the names of such persons who by each of them are Choosen according to the foregoeing Order being nine a peece Out of which the surueyr is to pick an equall number for the said appointed Jury as aforesaid Further Ordred a Veniri facias issue to the Coroner Thomas Vaughan of that County to sweare the said twelue persons after |
