46 Kent County Court Proceedings, 1648-1656. Liber A disciem all Right tittle Clerne or intreast for mee my heires Execu Admini or Assignes to all & euery pticulare of the sd Cattell & goods formerly mentioned & exprest And doe aliso further Coueñant bind & engage my self e tht the sd Mary shall haue free liberty all the tyme of her life to disspose of all or any part of the fore mentioned Cattell and goodes And at the expiration of her time heare upon earth If God giue her will .& opertunitie, then by will gift or legasi to dispose of the same to her Children or whom shee pleasses as beinge her owne Estate without the lett or hindrance of mee the sd Roger Baxster my heires Execu Admini~ or Assignes or any pson or psones Claiminge Right or Intreast from or undr mee or myn, And if it soe happen tht the sayd Marie depart this luff without will or dispossal of the sayd Cättell and goodes tht then the same bee left to bee dispsed of at the discression of the Court to her Childre if then beinge or otherwayes accordinge to equitie and & Contience I doe further Couenant & bind my selfe as before tht the sd Marie shall haue free libertie to dispose of either or both her Children to any pson or psons for their bettr Education & bringinge up allways puided tht this disposall bee not done Rashly but to take the aduice of sume twoe honest neighboures or to haue the aprobation of the Court and for Confirmation I haue heareunto put my hand in the prsents of the Court this first of Januarie 1655 Test Tho Hill Clar Sig~ Roger R B Baxster Know all men by theese prsents That I Isake Iiiue of the Isle of kent planter, haue & doth acknowledge to haue bartered sould bar gained & made sail of one broune Cowe & her Calfe, with whitte homes & whittishe gray towards the end of the taille, and a hole in the Right eare, & the left eare Cropt, & half e of the left eare tacken away, unto Thomas Wetherly which afforesayd Cowe, with her increase, I the afforesayd Iliue doth by theese, Acknowledge a free & firme sail by mee & from mee my heires Exec Admini~ and As signes foreuer unto the afforesayd wetherly his heires Exec~ Admini & Assignes foreuer to haue & to hould keepe & possesse & Enioy peacably as his owne pp goodes, & I doe further bynd my self e my heires Exec Admini~ & Assig unto the afforsd wetherly his heires Exec Admini~ & Assig~ to keepe indamnefied & saue harmles foreuer from all letts hinderances molestations of any pson or psons tht shall by any cleme whatsoeuer molest or disquiet the afforesayd Witherley his Execu~ Admin or Assignes in their quiet possession & peacable Enioyment of the afforesaide & theire increasse as wittnes my hand this first of Januarie 1655 Test Rob Vaughan Isa Iliue Wm Leedes |
