362Talbot County Court Proceedings, 1662-1674. Liber BB Shorte, with A Tobacco stick in his hand untill hee Came neare the No.2 watter side, but knew nott the Cause, nither did hee say any thing, Nor the said John Shorte, butt Presently after yor Deponant went to the watter side (with others) where wee saw the Place where they said That hee was Drowned, which was about Twenty yards in the watter, And the said Mr South Coming up from the watter side, Saith, That hee said to the said John Shorte when hee was att the watter side, That if hee Could stand in the wafter that hee Could stand by the watter side heare, And further saith nott signum Richard R Fillinggam [p. 11] 11] Anthony Purss aged about Twenty seven yeares or there abouts sworne and Examined. Saith That upon Munday Last Past being the month of Novem ber about Eight A Clock in the morning, your Deponant Comeing into the Plantation of Mr Thomas South, neare about the offen he meete with John Roys who said to yor Deponant goe doune to the watterside yendor, and help John Shorte for my Master is gone after him, to beate him; soe immediatly after yor Deponant, heard as hee suppossed the man in the watter striueing for breath where upon your Deponant Runn, as fast as hee Could to the watterside, where he just saw him striveing and holding up his hand, and as he suppossed his tooes aboue watter and soe immeadiatly sunke downe, Butt your Deponant blameing the said mr South that hee had nott Called some Body Sooner: for the said South Bid your deponant Call John Roys, which hee did, and the said Roys Came Immediatly and Run into the Place in the watter, where they saw the man sinke, which was about Twenty yards in the wafter, butt Could nott finde him, butt the said Mr South was nott wett, nor had nott bin in the watter, Butt after the said Shorte was Drowned, yot Deponant heard the said Mr South say, that he said while hee stood by the watter side, that if the said John Shorte Could stand in the watter, hee Could stand by the watterside: And Further saith nott signurn Anthony PA Purss Wee of The Jury before mentioned, by virtue of these depotions haue unanemusly agreed And doe finde that John Shorte Late ser vant unto mr Thomas South is Fielo Desi: And this is our virdict that hee ought nott to haue Christiall Buriall by Law. Tho: Hynson senor fore man Mrs Frances Morgan of the County of Kent Relick plantff Alexan der Mecattor Deift in an Action of Debt yor Pettioner Craues warrant and it's granted. That whereas Mrs Frances Morgan hath due by Bill from Alex ander Meccoker the summ of seven hundred ninety and one pounds |
