146Kent County Court Proceedings, 1656-1662. Liber B tht he had the Beefe, but in regard the businesse is not Fully Cleared unto the Court, either by the Plant or Deft whereby true Judgmt might passe thereupon, the Court wth the Consente of both ptyes hath, & doth order a Refenance in this Cause unto the next Court to be holden on the Isle of Kent [fol. 46] John Deere Plt Henry Carline Deft The Plant demands satisfacon For his goods taken away by an uniust proceedinge of Henry Carline when he was Sheriffe for this County by reason of not Appraisinge the sd goods accordinge to Law, whereupon they Joyne Issue The Court upon a longe debate in th Cause haueinge well con siderd the prmicesse with the testimony, doth therefore order, that the sd Deft shall pay to the Plant one hundred & eighty pounds of Ton. & Caske all Court Changes, Else Execucon, But the Court Findinge tht the Plant hath eighty two pounds of Tob in his owne hands of the Deft, the Court doth order the same to be discounted hereupon in the plts one hands. Henry Canine cominge before this Court Contemptiously his hatt on his head contrary to sciuill respect to Maiestrates & to an order of Court formerly past in tht behalf e & openly read in the prseflce of the Court & to the sd Canline who is disobedient there unto not withstandinge the Admonition giuen him by the sd Court to yeald obedience, But the sd Canine refusinge The Court Consideringe the Contempte doth therefore Order tht the sd Henry Canine shall pay for a fine 300lb of Tob & Caske to the Lord propniatary & Court changes else Execution Whereas two Attachmts Issued out against the Esstate of Peter Parker, one for mr Henry Morgan of two thousand pounds of To15 & one for mr Tho: Ringgold of two thousand flue hundred Pounds of Ton, & one for william Gnanger against the Esstate of Robt Tyler for one hundred & Fifty pounds of Tob The Court Consideringe tht the ptyes beinge called by the Sheriff & none to answar to the Plts plea upon the Attachmts & that noe full proofe doth yet appeare tht the Defts are fled out of the Prouince, The Court doth therefore order tht the Plnts make their Appearance the next Court, & in casc the Defts answar not accondinge to the tenure of the writts, that a Just proceedinge may Follow upon their Esstates, And tht the Sher iffe bringe in all the Acc° & bills of the sd Parkers to the next Court At A Count holden at the Court house on Kent the 15th day of Decemb 1658 prseflt Capt Robt Vaughan Capt Tho: Bradnox Mr Phillip Conner mr Henry Morgan Comrs mr Joseph Wickes |
