Kent County Court Proceedings, 1656-1662.103 Whereas Math Reed hath sued John salter for A Debt Dew by Liber B bill of Three hundred fowrty flue lb Tobacco & Caske: which is Acknowledgd in Court by The Defendent wherefore The Court hath Orderd prsent Payment ellc Execution: with Court Chargis: Whereas Math Reed hath sued Mr Thomas South in an Action of slander And hath Proued by severall Deposetions That The sd Mr south hath Cald him knaue And That he would Proue him one: But Mr south not Prouing The same: The Court hath Therefore Orderd That The sd Mr South shall Confes And Acknowledg his 0 fence in open Court: And to Repayer And make good Crany Bridg That it be suffitient to pas ouer secuerly at all Tieds And to keep it in like maner for one wholl yeare: And pay Cost of suit: elc Execution The Jurys Vardict the 2th of March: 1656: Wee of the Jury being Agred in our Vardict doe find by The Evedenc That The sd John Deare is not gilty of susspition of fel lony nor by The lawes of The Countery Edw Copedg fore man Wherefore The Court hath Orderd That the sd Mr Morgon Plantiue for not making good his Action And Charge shall pay Cost of suit/ elc Execution: Mr Henery Morgon here vpon Craues An Appeall to The next Prouentiall Court held for the prouence ether at Provedenc or Potuxson: wch The Court hath granted he puting in bond wth secur ity for Duble Dameges if he be Cast in the suit: Whereas Mr Cooll by his Atturny Mr Henery Carlien haue sued John Deare in an Action of Debt And hath made Appeare Dew by Bill Two hundred Ninty one lb of Tobacco And Caske: Which The Court hath orderd prsent payment e!c Execution with Cost of suit: Whereas Mr Henery Carlien The Atturny of Mr faster haueing sued John Deare for The Deliuery of fouer Cowes vpon Condition And bill of saell: which The sd Deare hath Acknowledged: where fore The Court hath orderd That The sd Deare shall Make Deliuery of fouer Cowes Upon Demand And pay Cost of suit elc Execution Whereas John Deare haueing sued Mr Isack Iliue And haueing Made nothing Appeare Dew: The Court hath Therfore Orderd That The sd Deares Casse be Dismist And pay Cost of suit Elc Execution: Whereas Mr Tho: Ringgold hath Pettitioned The Court Agst Mr Wickes for som Corne Dew to him which was The last Court in question And not yet fully esued Mr Hen Carlien The Atturny of The wickes Craues A Reference in the Case: which is granted: |
