sembly " In the Preamble whereof Notice is taken That by the
great distance between that Province and Great Britain It was
Impossible to have Notice of the Demise of Queen Ann which
happened in the August preceding till several Months were Elapsed
during which time many Proceedings were had in the Court of
Justice in the Province & Judgm.ts &c Awarded on Sundry Writs
& in her Matys name and by her Authority which by reason of the
late Kings Accession which co.d not be Notifyed were Lyable to be
reversed by Writ of Error or otherwise. It is therefore Enacted
That all Pleas &c Prosecuted to Judgm.t since the Queen's Demise to
the end of the then Session of Assembly shall be Effectual not-
withstanding such Demise or the want of Jurisdiction in the Courts.
This seems to be the only Act in the Collection of the Laws of
this Province the least Apposite to the present purpose and at the
time this Law was made the Governm.t of the Province was in the
hands of the Crown who had resumed it on Account of the An-
cestors of the present Lord Prop.ry being Papists.
The Act of 7 &i 8 W. and Mr. Cap. 15. for Extending the Con-
tinuance of the Parliam.t here to 6 Months after the Demise of
the Crown does not extend to the Plantations.
Your Opinion is hereupon desired for the Information and As-
sistance of the Lord Prop.rys Guardians.

Ist......With respect to the 2. Acts of Assembly herewith left and
the Legality and Propriety of each Whether either and which of
them is proper to receive the Assent or Dissent of his Lordships
Guardians.
2d.......Whether the several Acts of Assembly passed after the
late Lord Prop.rys Death but before it was Notifyed in the Province
are therefore to be Considered as Null and Void for want of Juris-
diction in the Legislature there to pass the same or are to be
Considered as Valid and Effectual & may properly receive the As-
sent of the present Lord Prop.rys Guardians notwithstanding the
late Lord was dead before they were passed.
