76 Provincial Court Proceedings, 1663. Liber B B That Mr Willm Battin dyed indebted unto yor Petr the sume of 4420l Tob & Cask, as by Bond appeareth, Wherefore yor Petr hum bly Craues order of this honble Court for the sd Tob, agst the Ad thistratrix of the sd Battin wth Cost of suite, And hee shall pray &c John Saffin plf The plf sueth as in his Pet” for Tob, But not Margery Battin deft according to the writt entred, It being for money Sterl. The Deft therefore Craues abatemt of the writt, Wch was graunted. Warrt to the sheriffe St Maries County to Impanell 2 Juries, Vizt, a Grand Jury & Petite Jury, & to make Ret. forthwth. By order of the Board Willm Bretton/ Vid fol. To the Rt honble the Gouernor & Councell of Maryland & The humble Pet” of John Tucker, Sheweth That wheares there is an Order of Court passed agst him for 3000l & odde Tob. to Raymond Staplefort, Yor petr neuer hauing had the Consideraon of the sd Debt, Humbly Craueth Iniunction to stop further proceedings in Common Law & to haue a hearing in Chan cery. Petr bee suspendd, it being for Three Thowsd one hundd seuenty Two pownds of Tob & Cask, And tht Raymond Staplefort then pH, haue till next Prouinciall Court to make his demand appeare due: & an swere to what is obiected agst the Bill by the Petr Concerning the Consideraon receiued, for wch tht Bill was passed.
