The humble Peten of Josias ffendall & Robt Hundley Admistrators to the Estate of Christopher Russell Deceased, SWeth That whereas Samuel Smith Deceased stands indebted to the Christopher Russell the summe of ffourteene hundd Pownds of Porke y0r Petrs therefore humbly cranes yor honrs to grant them order agst Mr Robt Slye Adthistrator of the sd Smiths Estate & they shall as in duty bownd pray &c: Josias ffendall . The plfs sue as in their Petn for 1400 of Porke, Robt Hundley - t And the deft confesseth Judgm for soe much to plfs the plf Robt Slye deft Thomas Nottley plf. The plf Declares agst the deft in an accon Willm Price undertaker of Debt & demandeth tht the deft doe for Hannah Lee deft forthwth pay unto the plf the just quanty of Twelue Thowsd Two hundd Twenty & Two pownds of Tob & Cask according to the tenor of one obligaOn bearing date the 14th day of March 166i whereby the deft together wth Christopher Rus sell now Deceased became Joytly & seuerally bownd as undertakers in the behalfe of the aforesd Hannah Lee to prforme the same. And [p. 50] allthough the deft hath bene often time requyred & intreated to dis charge the Sd obligaOn, yett hee still hath, & yett doth refuse to sat isfy the same, Wherefore the plf prayeth Judgmt of this honble Court agst the deft for the Debt & for costs of suite. Hannah Lee the Imployer of Willm Price deft acknowedgeth the ballance of the plfs account, being Three Thowsd seauen hundd thirty & fowre pownds of Tob & cask. Ordered tht the plf recouer accordingly. Thomas Lomax the Attorney of Mrs Margery Battin Came this Vid fol. 49 day & acknowledgeth in open Court tht hee hath receaued of Mr Robt Slye the Admistrator of Samuel Smith Three hundd pownds of Tob. & Cask, according to an Order of Court this day had & obteyned for soe much. Robert Slye the Admistrator of Samuel Smith came this day & acknowledgeth in open Court to haue receaued full satisfaction from Mrs Margery Battin Admistrix of her husband Wm Battin De ceased Six Thowsd ffiue hundd pownds of Tob, due to the Estate of the Samuel Smith, according to an order of the Prouinciall Court passed in Octobr last. Thomas Lomax the Attorney of Mrs Margery Battin came also this day & acknowledgeth in open Court to haue receaued of Mr Robt Slye the Admistrator of the Estate of Samuel Smith full Satis |
