268 Provincial Court Proceedings, 1664.
Liber B B Henry Thickpenny aged 30 yeares or thereabouts saith that Mr
Sadler deliuered his bill in to Jno Read in his life time not aboue
2 dayes before he was Cast away and about a yeare and a halfe agoe,
Thomas Paggett came and demanded this tobacco of me againe and
told me that he had paid it to r Stanley, and I asked him by whose
Order he had paid for I gaue him none and told him that he knew
that was to be paid upon the plantacon of John Read for he was a
wittnes to the Bill which bill was neuer out of my keeping since the
death of Mr Sadler, untill the 14th day of July and then I deliuered it
to Mr Stanley before Mr Charles Brookes, which bill Mr Stanley
neuer saw since it was in my keeping untill that time nor neuer knew
of it to my knowledge and further saith not.
Sworne in Open Court Philip Caluert
[p. 334] Henry Thickpennys Other Oath sworne saith—
That he being att the house of Thomas Paggett in or about 9br
1661 there Came Mr Giles Sadler to Thomas Paggetts for a hhgd
of tobacco and Mr Andrew Cook was wth him, and Tho: Paggett
did pay a hhgd of tob: to Mr Sadler but the weight I doe not remem
ber and Mr Sadler paid the same hhgd to Mr Cooke which hhgd of
tobacco I heard Tho: Paggett say was due to Mr Sadler for ffees and
about an accon of slander—
The widdw of George Read sworne saith
Her husband owed Henry Thickpenny tobacco and he paid it to
Mr Stanley in leiw of that tobacco Hen: Thickpenny owed Mr Stan
ley and further saith not—
Sworne in Open Court Daniel Jenifer
After some disputes the pit: was put to proue his daffiage who
alleadgeth by his Attorney Capt Manning that it was spoken in an
open Store, the Board not thinking that sufficient proofe the pit:
then desires Mr Sprigg may be examined upon Oath who was sworne
and saith—
What he knew in this Bussiness, he was at Mr Mountforts store
there was Thomas Paggett and Mr Stanley and some words they
had about a bill and that Paggett did call Mr Stanley Knaue and
Cheating Knaue and that hee may proue it, but he knew Nothing of
an actuall damage to Mr Stanley and further saith not—
Demetrius Carthwright sworne saith
I cannot say any thing in this Bussiness that I cann remember,
being askt by the Chancellor was those seruants that yow promised
Mr Stanley deferr'd upon this accompt by yow Hee answered yes
upon this Occasione I did, being askt what Interest had yow in put
ting off the Cargoe he said he was at that time imployed Ioyntly wth
Mr Mountford, and askt did yow upon these uery words of Mr Pag
getts in calling Mr Stanley Cheating Knaue delay'd yo”' from selling
