208 Letters to the Governor and Council

cated at the time — but seemed sensible and fit for duty — this deponant
being askt if since Captain Deaver has been on actual duty if he has
seen him drunk or unfit for duty by drink — says that for the 20th to
the 23d between the 20th & 23rd Instant he thinks he see Capt Deaver
so much intoxicated as to render him unfit for duty.
Joseph Lemane being sworn deposeth and saith that he was a
Sergeant of the Guard when Captain Deaver's company was on duty
on the 21st Instant, and was told by Captain Deaver that when he
Captain Deaver was in he had the Command and when he the Captain
was not there he the deponent had the Command. And that he re-
ceived all Orders from the Captain when on that duty — that Captain
Deaver he apprehends on that duty was intoxicated with drinking
but does not know whether he was so much intoxicated as to render
him unfit for duty as an Officer — this deponent further saith — that
on the night of the 21st Instant between the hours of eight and nine
o'Clock — Captain Galbraith Mr Kennedy and Captain Deaver came
into the Guard House Groggy and Captain Deaver furnisht Gal-
braith & Kennedy with a Guard to see them safe home.
Isaac Sitler being sworn depose and Saith that on friday night the
20th Instant he was on Guard when Captain Deaver had the Com-
mand. And that Captain Deaver was intoxicated with liquor — that
at another time the Company was Ordered out to meet at nine
O'clock in the morning and was kept by Captn Deaver till three
o'Clock in the Afternoon during which time the Captain was drink-
ing with William Rusk one of the privates and that he was obliged
to pledge his coat to pay for the liquor this deponent being askt if
that was the day they drew their rations — says it was — Upon being
ask't If he apprehended Captain Deavers drinking at the time he was
on duty rendered himself fit for duty then at any other time says he
thinks it did not for that in his opinion at no time he was fit for duty

Francis Marble being sworn deposeth and saith that on Friday the
20th Instant was a Guard and that Abraham Sitler was also on Guard
both privates in Captain Deavers Company — this deponent being
askt by Captain Deaver if during the course of that day or night he
saw him Drunk — but says he thinks not.
This deponant being askt if he at any other time when Captn
Deaver was on actual duty see him so drunk as to render him unfit for
duty — says he thinks he never did. This deponant being askt by
Capt Deaver if at the time of their drawing their rations he Captain
Deaver was drunk says that he does not know he see Captain Deaver
& William Rusk laying down by a Woman with a pale of liquor — this
deponant being Ask't that if on the night of his being on duty with
Captain Deaver he and Captain Deaver played cards and for what
they did play says they did play cards for a bottle of Rum or Brandy
but they coud not get it.
