1702 & which was confirm'd by her late Majesty Q: Ann in Council,
is entirely cut off, Sr the remaining 3 parts of their Subsistance is ren-
dered precarious, and therefore praying tht his Majty will be pleased
to Order tht the sd Complaint may be examin'd into, whereby not only
his Majestys Royal Prerogative, but also the just rights of the whole
Body of the Clergy, may be ascertain'd & maintain'd; their Lordships
on the 3d of this inst took the sd petn into consideration, together wth
a representat" of the Honble Cecils Calvert Esqr for & on the behalf
of Chars Ld Baltimore his Brother, Setting forth, amongst other
matters, tht as the said Petn greatly affected his Bror's Rights & Priv-
ileges, as absolute Lord & Proprietor of the sd province & particu-
larly as to his Right of approving or Repealing the Laws passed in
that Province; and tht as his Bror was now absent f m this Kingdom,
& an intire Stranger to such application, & had left no Instructions
or Authority with any person to Defend his Right, he therefore
prayed tht the sd petition might not be taken into consideration until
his sd Brother's Return who was daily expected in England: Where-
upon their Ldsps were pleas'd to put off the consideratn of the sd
petn to this day; when my Lord Baltimore's Sollicitor attended their
Ldps, & acquainted them that he was just arrived in England, &
prayed, tht in regard his Lordship as Proprietor, had constantly

enjoyed & exercised the power of Approving & Repealing the Laws
of the said Province, his Ldsp might hear & determine this Complaint
which his Ldsp had engaged to do with all Expedition upon the
Petitioner's Application to him & to grant them proper Releif. The
Lords of the Committee upon consideration thereof, & hearing what
the petitioner had to object thereto, were pleased to suspend for
the present all farther proceeding upon the sd Complaint

The Petition of Jacob Henderson Clerk in behalf of Himself &
the rest of the Protestant Clergy of the Province of Maryland

Sheweth
That the Clergy of Maryland are exceedingly aggrieved by an
Act passed at the Assembly begun & held there the 3d of Octber 1728
wch bears for its Title an Act for Improving the Staple of Tobaco,
& has, as yr petitioner is inform'd, been Transmitted to yr Lord-
ships hand, under Seal.
Which Act (as yr petitioner apprehends) is not only unreasonable
in it self, but also deprives the Clergy of the Maintenance lawfully &
solemnly provided for their support & subjects them to several mean
