the sounds that Divide Taylor's & James's Islands from the
main Land: By the Land Patents they are deemed Islands,
But of this, I write you My Lord's determination with Messrs
Penns Novembr 27th Your Transmission of the Copys of the
Journals of the Assembly the 28th of March last I have Mr
Secy Pitt's Lettr in the Journals dated the 30th of Decemr
1757. The Tenor thereof Certifys great goodness tender'd
by His Majesty, for Vigorous & extensive Efforts to Avert
the impending dangers on North America the Sincerity of
his Letr is so very Expressive as to have no doubt but that
the Marylanders wod Joyfully have embraced the opportunity
of distinguishg themselves for His Majesty's Zeal in Defence
of his Dominion & themselves. Notwithstanding the Jour-
nals relate much Altercation on that Subject upon a Bill from
the Lower House sent to the Upper, of wch on Clauses in the
Bill upon deprivations of Rights, Inter als concerning Ld
Baltimore the Upper House reply We conceive that by the
clear words of the Charter the appointment of all Officers
Civil & Military belongs to Ld Baltimore for further Satis-
faction on this Point they Add, the Opinion of Ld Chief Jus-
tice Wille's when Attorny Genl whose opinion is, That by
the Charter of Maryland the Lord Proprietary hath a Right
to nominate all Officers Civil & Military They observe if
the Charter did not determine this Matter in favour of Ld
Baltimore, they wod not suffer their Estates to be Tax'd by
Officers deriving their Power under the Sole Nomination
of them, who wod naturally think themselves peculiarly Ac-
countable for their Conduct to that House And Exemplify
the improprietes of the Bill on his Lordps Private Officers,
words vague & undetermin'd, not Sure agt Complaint or
Even a prosecution however Exact they might be & under
Penalty £200 witht Reward near the same proved on the
Publicic Officers & set forth the unreasonable Power the Lo:
H. Assumes, to be sole Judges of the Allowances to be made
to such Persons as have been put to an Expence in provid-
ing Necessaries for his Majesty's Troops in their winter
Quarters, A Power unpresident'd Object to the double Tax
on non jurors as the Effect to Banish them from the Country,
agt the Principle of Justice & Policy & agt an Assembly Act
for an Limited Toleration of all Christians in 1640 Objt agt
a Tax upon all Commodities imported into the Province from
England (ive.) the Manufactory of the Mother Country
Objt to a Tax upon uncultivated Lands yeilding no profit.
Because such a Tax wod fall upon the Real & Personal Es-
tates of the Owners yeilding a Profit, whch are otherwise
tax'd by the Bill Objt to the Power to the Tenant to Restrain
