That Mr Carrol had likewise obtained a Grant from his
Lordship the Lord Proprietary & his Guardian the Lord
Guilford to be Receiver General of all his Lordships Revenues
growing due in this Province upon Export of Tobo or other-
wise by Act or Acts of Assembly or by Virtue of his Lordships
Royaltys Rights Privileges & Prerogatives within this Province
And particularly the two Shillings & nine pence p hhd and
fourteen pence p tonn are therein Expressed. In which Duty
of two Shill & nine pence the 3d p hhd appropriated for pur-
chasing Arms for the Defence of this Province and the other

3d for defraying the publick charge of this Province are
included as well as the 12d raised for Support of Government
besides his Lordships Duty of 18d in Consideration of his
Rents being paid one half in Tobo at the Rate of two pence p
pound. So that Mr Carrol has deceived the Lord Proprietary
in his tender age & also his Guardian in imposing upon them
to grant him such a Commission contrary to the afd Acts of
Parliament and his Duty to his Lordship the Lord Proprietary
and the said Mr Carrol having refused to take the Oaths
appointed instead of the Oaths of Allegiance & Supremacy
And the Oath appointed in the Act made in the fifth year of
her late Majesty for Securing her Person & Government &
the Succession of the Crown of Great Brittain in the Pro-
testant Line, and also Enjoined by an Act of Assembly of
this Province still in force & unrepealed to be taken & Sub-
scribed by all Persons in this province who shall hold any
office or Place of Trust within the same & without the doing
whereof no Person can be capable of holding Executing or
Enjoying any office or Trust in this Province
His Excellency asks the Advice of the Members of his
Lordships Council First whither the sd Mr Charles Carrol has
not imposed upon the Lord Proprietary and his Guardian in
obtaining such Commission, And secondly, whither the said
Mr Carrol (having refused to take & sign the Abjuration Oath
above mentioned according to the Tenour of the Act of As-

sembly of this Province) be capable of holding Executing or
Enjoying any office or Trust in this Province which do or
may Concern the publick Affairs or Interest thereof
As to the first Question all the members of his Lordships
Council now present (save Mr Philemon Lloyd) are of opinion
that Mr Carroll has by applying for that Commission de-
ceived & Imposed upon their Lordships, For that though
their Lordships peradventure might be ignorant of the
afd Acts of Parliament and Act of Assembly of this Province
yet Mr Carrol could not
And the said Mr Lloyd says that He cannot agree that
