Wednesday 12th Nov. 1712

The House met according to Adjournment. Being called
over were all present as Yesterday.
Read what was done Yesterday
Bill to redress the great Evil accruing by the Multitude of
useless Horses Read the first and second Times by Special
Order and will pass.
Sent up to the Council by Mr Clagett and Mr Govert Lock-
erman
They return and say they delivered the Bill
Bill permitting the Inhabitants to sue out Writs and confess
Judgment in their proper Persons Read the first and second
Times by Special Order and committed for Amendment
The Bill and Message prepared last Night relating to the
Indians sent up to the Council by the Members of Dorchester
and Somerset Counties.
They return & say they delivered the same
The two ingrossed Bills assented to Yesterday sent up to
the Honble Council by Mr Tyler, Mr John Mackall, Mr Mariar-
tee & Mr Scott.
They return and say they delivered the Bills
The Message relating to the Bill reinvesting Seward's Heirs
into certain Tract of Land Ordered to be prepared last Night
Read approved and ordered to be entered Viz.

By the House of Delegates
11th Novem. 1712

We cannot concur with your Honours that the last Indors-
ment on this Bill by this House is any ways unparliamentary
but are of a contrary Opinion and well assured that this Ses-
sion is the Time to which the Bill was last referred, and that
every Session of Parliament is in Law a new Parliament. We
are not unsensible of the Difference between an Adjournment
and a Prorogation, and the last was neither but a Dissolution
and so this a new Assembly and if all Matters referred from
the last to this should be discontinued it would be very incon-
venient for then every Thing not then finished must begin
anew, and then to what Purpose is any Referrence when it's
in the Power of any Governor to dissolve the Assembly and have
a new one every Session? or to what Intent does the House
of Commons at the Election of a new Speaker read some of
the Bills that did not pass the Royal Assent the last Session
(as it were to give him Seizin of the House) if according to
your way of Reasoning they were discontinued and must be-
