An Act requiring the Masters of Shipps and Vessells to pub-
lish the rates of their ffreight before they take any Tobacco
on board.

Be it enacted by the Queens most excellent Majesty by and
with the Advice and Consent of her Majestys Governour
Councill and Assembly of this Province and the Authority of
the same that every Master and Comander of a Shipp or other
Vessell that purposes to export Tobacco on ffreight shall before
he take any such Tobacco on board his said Shipp or Vessell
publish in Writing by a Note under his hand which he shall
Cause to be affix'd on the Court door of that County where
his said Shipp shall ride at Anchor at what rate he will receive
Tobo upon freight p Tonn on board his said Shipp for that
intended Voyage which Note the Clerk of the County shall
enter upon Record.
And be it further enacted by the Authority aforesaid that
whatsoever Merchant or other inhabitants of this Province
shall put any Tobo on board any Shipp Sloop or boate belong-
ing to a Shipp on ffreight before such Master of such Shipp

hath sett up such Note as aforesaid he shall forfeit and loose
all such Tobacco so Shipt on board such Shipp sloop or boate
or the full value thereof in mony Whereof one half to her
Majesty for Support of the Government of this Province the
other half to him or them that will sue for the same to be
recovered in any Court of Record in this Province by Accon
of Debt bill plaint or Information wherein no Essoyn protection
or Wager of Law to be allowed.
And be it further enacted by the Authority aforesaid that if
any Master Comander of Shipp or other Vessell as aforesaid
shall take any such Tobacco on board his Shipp or Vessell
before he hath publish'd such Note as aforesaid he shall forfeit
for every such hogshead the Sume of twenty shillings to the
uses aforesaid to be recovered as aforesaid.
And be it further Enacted by the Authority aforesaid that
every Master & Comander of Shipp or Vessell as aforesaid
that shall send any Sloop or other Craft to another County to
fetch Tobacco to be put on board his Shipp or Vessell on
freight shall send by the Skipper or Master of such Sloop or
other Craft a Certificate under the hand of the Clerk of that
County where such Note of freight was publish'd as aforesaid
Certifying the rate of his freight and publication thereof as
aforesaid under the penalty of forfeiting forty shillings sterl to
the uses aforesaid to be recovered as aforesaid And the Col-
lectors and Navall Officers shall at the Charge of the County
where such Collectors and Navall Offrs inhabitt procure Copys
of this Law for each Copy whereof the said County Clerk shall
have tenn pounds of Tobacco and no more and affix the same
