person or persons so licens'd or to be licensd to Keep Ordi-
nary as aforesaid shall during the time of such their Keeping
Ordinary be delegates or Justices of the Peace for any County
within this Province.
And be it further Enacted by the Authority aforesaid that if
any Ordinary Keeper shall keep evill rule in his house upon
Complaint made thereof to the Justices of the County Court
of such ordinary Keepers Misbehaviour or Keeping evill rule
in his house the said Justices of the County Courts are hereby
Authorized and Impowered to Suppress such ordinary Keeper
and Call in such Lycense.
And be it further Enacted by the Authority aforesaid that
any Ordinary Keeper disabled or Supprest as aforesaid or any
other person that shall presume to keep Ordinary without
Lycense first had and obtaind as aforesaid shall for every
Month he or they shall Keep Ordinary as aforesaid fforfeitt
and pay two thousand pounds of Tobacco and so proportion-
able for a longer or shorter Time that any persons shall sell
Liquors or doe contrary to this Law One half to her Majesty
her heires and Successors for the use aforesaid and the other
half to him or them that shall sue for the same to be recovered
in any Court of Record in this Province by bill plaint or Infor-
mation wherein noe Essoyn protection or wager of Law to be
allowed
And be it further enacted by the Authority aforesaid that no
person or persons Inhabitting within this Province not having

lawfull license shall sell by retaile any Syder Quince Drink or
other strong Liquors to be drank in his her or their Houses or
about his her or their Plantations upon forfeiture of every
time he she or they shall be legally Convict thereof the sume
of one thousand pounds of Tobacco One half thereof to her
Majesty her heires and Successors for and towards the Defraying
the County Charge where such forfeiture shall become due
and the other half to the Informer or to him or them that shall
sue for the same to be recovered in any Court of Record
within this Province by Accon of Debt Bill Plaint or Informa-
tion wherein noe Essoyn protection or Wager Law to be
allowed.
And be it farther enacted by the Authority aforesaid by and
with the Advice and Consent aforesaid that no person or per-
sons whatsoever so lycens'd to Keep Ordinary as aforesaid
shall refuse to Creditt any person Capable of giving a Vote
for Election of Delegates in any County within this Province
to the value of four hundred pounds of Tobacco per Annum
for any Accomodation by him vended whereof any such per-
sons so capacitated as aforesaid shall have occasion of or
require to be accomodated withall under the Penalty or ffor-
