By the house of Delegates
Septr 27 1704

This house desire your honors to Consider the Good that
this Act has done by 9 or 10 Years use Without Any Com-
plaint Against it As Also that in Appeale or Writt of Error
the Superiour Court cannot review the lustice of the fact As
You Seem to be of Opinion but only the Errors in law And
its too true that for a Nicety in law many a lust Iudgment
has been ouerthrowne Since the Countrey is not capable to
come up to the rules of the laws of England in the regularrity
of their proceedings for Want of Abillity both in ludges And
Officers And Wee haue no Statute of Jeofailes to help us.
Consider Alsoe wee pray, that if A man is Wrongd in lus-
tice or Equity in any ludgment Aboue 1200: the Court of
Chancery can releife him And that Answers the Supposition
of Yor honors of Want of right or lustice to any person for A
lust debt
And With Submission wee hold this law as drawne Abso-
lutely necessary for the Welfare of this province Which carrys
no other designe then to restraine litigious, persons for Catch-
ing Advantages by the Strict Rules of the law which Wee are
not Able to Comply with And therefore Wee Earnestly desire
Yor honors Consideration And Concurrence to A law so much
for the Good of the province. Which if Wee can't obtaine
Wee haue done our dutys And shall say no more.

Ennalls Mr Francis Dollahyde.
They returne and say they deliverd the same.
The house Adjourns till 2 A Clock in the Afternoone.

Post Merediem

The house met Againe were calld over and present as
Yesterday.
Mr Richd Iones A member for Ann Arrundell County made
Application to the house that he might Go home being ill with
the Gripes Which is granted he tooke his leave & withdrew.
The house proceed to proportion the fees for coppys of the
laws And private bills.
Resolvd that 1500H tobacco be Allowd for every Coppy of
the laws this Sessions and 400l tob for each Coppy of the laws
last Sessions,
Iames Sanders Esqr enters the house & delivers Mr Speaker
the bill for Appeales & Writts of Error.
