Order to be duly Observed as he or they will Answer the Contrary at their Perill And that your Majesty will be pleased to Give such further and other Directions as will be Effectual to Cause such Restitution to be duly made to your Petitioner or his said Agents for your Petitioners relief in the Premises as your Majesty in your Consummate Wisdom shall think proper And your Petitioner shall ever pray &c

Upon reading this day at the Board a Report from the right Honourable the Lords of the Committee for hearing Appeals from the Plantations dated the 17th of June last in the words following vizt
In pursuance of an Order in Council of the 21st of Febru ary last referring to this Committee the humble petition and Appeal of Jonathan Forward of London Merchant against Gilbert Poulson from Maryland their Lordships appointed this day for Considering the same and do find the said peti tion sets forth (int alia) that on the 5th September 1717 The Apellant entred into Charter Party with the said Gilbert Poulson Master of the Ship Dolphin for the Freight of the said Vessel for Transportation of 131 Servants to Maryland or Virginia and to bring a homeward bound Cargo back from thence to the Apellant within ten days after Delivery of which Homeward bound Cargo in the Thames the Apellant was to pay the said Poulson after the rate of 50 ls p month for each month his Ship should be out in the said Voyage and accord ing to which Agreement the said Poulson delivered the said Servants in Maryland but thô no Part of the Ships Freight 111 became due ‘till the Ship arrived in the Thames, and thô the Appellants Factors had shipp'd a back Lading on board Poulson & directed him to sail for London & molested against him for not doing so, and thô the Appellants Factors there had paid the said Poulson a Considerable Sum of Money yet the said Poulson brought an action in the Provincial Court
