                 356 Proceedings of the Council of Maryland, 1719.

             

              c. P. Thirdly.

                   That the three months Expire the 26th of November, when

                 (if with Convoy) it would not be Safe for him to Venture up

                 on a Winter Voyage, with such ruined Constitutions as he

                 has the Charge of, and Care for; The Violent Sickness in the

                 Countrey being very great, of which his Family has had a

                 large share, and not yet Recovered.

                   To which his Excellency Adds, that he shall most Gladly

                 make use of his Majestys Most Gracious Leave to Return for

                 England, so soon as he Can Safely and Conveniently do it.

                   For that he shall Quitt the Station wth Joy, in which he has

                 Received such Barbarous Treatments of all Sorts, from the

                 Time he Opposed the Comissions granted in an Extra

                 ordinary Manner to Papists, in the Time of the late Rebellion

                 in Great Britain, which he takes to be the source and Cause

                 of all his Enemies Malice to him.

                   For on his Arrivall in this Province, (to which he Came

                 Honoured, by Patent under the Great Seale of Great Britain

                 to be Governour and Comander in Chief) he found Maryland

                 was Governed by the Laws of Great Britain, and those of this

                 Country In which he lived in Great Peace & Tranquility.

                 Dureing the Force of that Comission That he has made it his

                 Constant Care to Maintain those Laws, and to Support the

                 Liberty and Property of the People of this Province; And this,

                 On his Arrivall in England, he shall be Ready to Maintain

                 Against his most Inveterate Adversaries.

                   That as to the latter Part of the Instruction Relateing to

                 Delivering up the Seale, he shall Readily Comply with it at

                 his Departure.

                 To the third Instruction.

                   His Excellency Desires the Opinion of this Board, whether

                 they look upon it, he is to have any Support by the Law of

                 this Province which Provides for the Support of Government,

                 Dureing his Absence.

                   Whereupon It is the Unanimous Opinion of this Honble

                 Board. That there is no Provision made by that Law for his

                 Excellencys Support dureing his Absence.

                   Upon which his Excellency is Pleased to Observe that (If so)

                 he has no benefitt from the Intention of that Law from the

                 Time of his Departure, by which Instruction he is humbly of

                 Opinion That his Majestys Grace & Favour Intended to him

                 is Evaded, by totally Removeing him from his Office, Instead

                 of giving him leave to be Absent from it.

             

                               To the Fourth

                   His Excellency Desires the Opinion of this Board, as to
