Do promise upon my Safe arrivall in England (God willing) Lib. C. B. to Deliver to Coll Nathaniell Blakiston Agent for the Province of Maryland in order to Carry to their Lordshipps the Lords of Trade & Plantations & to take Coll Blakistons Receipt therefore. Evan Evans.
Whereas their Lordships the Rt honrble the Lords of Trade and Plantations require to know by what Authority his Exncy had Sent Benjamine Celie Humpherye Hernaman to Barbados. Ordered that a Representation be drawne up Shewing the p. 57 reasons viz, the Act of Assembly for Transporting of Celie the Conviction of Hernaman & the Imprisonment ffees for which by the Law of this Province he was obliged to make Satis faction by Service and the Advice & Concurrence of this Board to what his Excellency had done therein. Mr Philemon Lloyd Secretary of Maryland his Petition read and allowed viz.
To his Excellency John Seymour Esq her Majestys Capt Generall & Governour in Chiefe over the Province of Mary land and the honrble the Councill. The Petition of Philemon Lloyd at Present Appointed Secretary of the Province of Maryland Humbly Sheweth. That whereas by an Act of Assembly made at a Sessions of Assembly held at the Port & Towne of Annapolis the 28th Day of June in the year of our Lord 1699 Entituled an Act for Limitation of Officers flees it was there Enacted that the Clarke of the Provinciall Court among other Enumerated ffees, might Charge Eight pounds of Tobacco for Drawing any Proceeding of Court, not otherwise rated not Exceeding half a Side of a leaf. And by one other Act of Assembly made at the Port and Towne of Annapolis the 5th day of December 1704 in like manner Entituld An Act for ascertain ing Officers ffees it was Enacted that the Said Clarke of the p. 58 Provinciall Court might Charge Eight pounds of Tobacco for Drawing any Proceeding of that Court if it Exceeded half a Side of a Leaf here may it Please your Excellency the Nega tive not Inserted in the Same Article of the fformer recited Act of Assembly is omitted & left out; by which means the Clarke is withheld from Charging anything for a great part of the Proceedings of that Court to the great Detriment of the Secretarys Office & forasmuch as it Appears manifestly to be a mistake of the Transcriber & in no wise the Intent of the Assembly to Oblige the Clarke to those Services Ex-Officio, I do in most humble manner apply my Self to your Excellency & this honrble Board for Reieif in the premises.
