prepared for regulateing Ordinaryes appeares to be more to
the advantage and interest of the Province, then the formr,
and tht those ordinary fines, was not originally an inherent
right, but free Gift of the province, therefore the said Bill has
past the first reading, and is herewith sent up, prayeing the
honble councills concurrence

Collonell Edwd Dorsey a Member for Baltemr County entred
the house, and ordered tht Mr John Smith goe up to his Excy
& Councill to see him sworne
He returnes & sayes he seen him Sworne
Mr Jacob Lookerman and Mr Hugh Eccleston members of
Dorchr County enter the house and
Ordered that Mr James Smallwood attend them to the Govr
and Councill to see them Sworne
He returnes and sayes hee hath seen them sworne, there-
upon they tooke theire places in the house
Collonell Thomas Smith and mr Richard Tilghman appeared
in the house, & declared theire satisfaction in, & willingness
to take the oaths, &c
Thereupon ordered tht mr Jacob Lookerman & mr Jno Wright
attend them to his Excy and Councill to see them sworne
Whoe returne and say they have seen them quallified &
thereupon they tooke theire places in the house

Ordered the Clk goe to the Secretaryes office & bring wth
him the record of his Excys Comission, which being brought
was ordered to be read
The answer to his Excys message was read & ordered to
be Entred as followeth

Wee haue duely considered yor Excys Message to us by the
honble Thomas Tench and Thomas Brooke Esqrs & wee are
glad to see yor Excy soe candidly accept our respects wch pro-
ceeded from a true Esteem, wee haue of yor worth and honour
Wee haue considered the Indian Treatyes laid before us
and haue nothing to advise to be added, but tht the same may
be renewed under the prsent Articles
Wee haue carefully perused and Examined the Severall
Royall instructions of her Majestye to his Excy & sent us, and
in obedience to what his Excy requires of us to giue answers
in writeing to them, wee haue Endeavoured with our utmost
care to giue such as may become us, and be acceptable, &
