412 Proceedings of the Council of Maryland, 1696/7-98.
Lib. x. appearing before the Board Says that he being bound with his said Ship up the Bay into Sassafrax River was advised that he was to make entry at this Port therefore did not touch in at Puttuxent & prays he may be admitted to an entry here Ordered thereupon that he be admitted to an entry accord ingly. A Brief being produced read & Approved Impowering the several Collectors & Naval Officers to procure what Subscrip tions they can (from the several Persons concerned in Trade) to the Church & free School one of them is Ordered to be sent to each District Mr Kennedys Letter to his Excllcy is Re ferred to the Kings Lawyers Mr Ralph Rymer of St Marys County being sent for Came & being asked what he heard Mr John Cood say Concerning the New Governor Coming in— Gives the following Relation vizt That Some time the last week the said Mr Cood being at his house among several discourses passing took Occasion to acquaint him how that there was a New Govr coming in for this Province or words to that Effect to wch the said Mr Rymer made Oath before Robert Smith Esqr Chief lustice of the Provincial Court in Council Mrs Mary Vansweeringen being sent for Came and being Sworn to make true Answer to all such Questions as should be asked her is asked whether she did not hear Mr Philip p. 30 Clark say some time before he Came up to the Assembly that he would have a Paper wherein the Kings Lawyers have given their opinions burnt under the Gallows by the common Hangman who says she did hear him speak words to that Effect at her house in St Marys in presence of Mr Synnot Captain Waughop & Mr Harpam but does not know whether Mr Synnott might take Notice of those words by reason he was much Concerned that time in drink being the day the City Burgess were Chosen Mr William Harpam is sent for and Came Being asked whether he heard those words spoke. Desires time to Recollect his memory Mr Philip Clark being present is sworn to make true Ansr to Such Questions as should be demanded of him The said Clark being set down as an Evidence to these several Articles of Charge against his Excellency which were presented to the Justices & Grand Iury of the Provincial Court for their Answer were produced & read to the said Clarke as follows vizt And to the first Article being he intercepts & Causes to be Intercepted Pacquets & letters directed to Persons in Mary land & Virginia & elsewhere to the great Prejudice of those Concerned
