312 Proceedings of the Council of Maryland, 1696/7-98.
Lib. H. D. appointed by the Governors for performance of certain things menconed in the aforesd act for the Encouragement of trade coflionly known by the name of Navall Officers are to give secu rity of the Comrs of the Customs in England for the time being or such as shall be appointed by them for his Majties use for the true and faithfull performance of their duty. You shall take care that the persons by you so employed do not only give such security to the sd Comissrs of the Customs but be approved of by them in manner as thereby is enjoyned. Thirdly. Whereas by the said Act of Navigation no Goods or Comodities wtsoever are to be Imported into or exported out of any of the Colonies or Plantacons in any other Ships & Vessels wtsoever but in such as doe truly & without fraud belong only to the people of England or Ireland or are of the built of and belonging to any of the Lands Islands or Tern toreys as the proprietors and right owners thereof and where of the Master and 3 fourths of the Marriners at least are Eng lish under the penalty of the forfeiture and loss of all the Goods and Comodities wch shall be imported into or exported out of any of the sd Places in any other Ship or Vessell, as also of the Ship or Vessell with her Guns furniture &ca And whereas by a clause in the aforesaid act of frauds no forreign Built Ship (that is to say) not built in any of the Dominions of Asia Aifrica or America, or other then such as shall bona fide have been bought before the first of October 1662 and expressly named in the list thereby appointed to be made of all forreign built Shipps in all the Ports of England shall enjoy the Priv ilidge of a Ship belonging to England or Ireland altho own'd or mann'd by English (Except such Ships only as shall be taken at Sea by Letters of Mart or Reprizall & Condemnation made in the Courts of Admiralty as lawfull prize) but all such Ships shall be deem'd as aliens Ships and be liable to all duties that aliens Ships are liable by virtue of the aforesaid Act for the Encourageing & increasing of Shipping & Navigation. And whereas by a clause in the aforesd Act for preventing frauds and regulating abuses in the Plantation trade ‘Tis Enacted tht after the 25th of March 1698 No goods or Merchandizes wtsoever shall be imported into or exported out of any of his Majtes Colonies or Plantacons in Asia Aifrica or America or shall be laden in or carryed from any one Port or place in the said Colonies or Plantations to any other Port or place in the Kingdom of England, Domin ion of Wales or Town of Berwick upon Tweed in any Ship or bottom but what is or shall be of the built of England or of the built of Ireland, or of the said Colonies or Plantations and wholy own'd by the people thereof or any of them & Navigated wth the Master & 3 fourths of the Marriners of the said places p. 153 only (except such Ships only as shall be taken prize & condem
