    Thomas Tench Esqr is concern'd. Ordered that the same be Lib. H. D.

    tryed this night, and tht the Attorneys on both sides con

    cern'd have notice thereof accordingly.

      Sr Thomas Laurence came and is added.

      Produced & read an Oath drawn up by his Majtes Lawyers

    to be taken by his Exncy the Governr and his Majtes Honoble

    Councill as Iudges of his Majestes most Honoble Court of

    Appeals and writts of Error. Whereupon his Exncy is pleased p. 587

    to aske if they have anything to object against it, who say

    they have nothing to object but think the same very proper

      Ordered that the Honoble Coll Henry Iowles Keeper of the

    Broad Seale of this his Majtes Province Administer the said

    Oath to his Exncy and the severall Members of his Majtes

    Honoble Councill present, and were sworn accordingly his

    Exncy ffrans Nicholson Esqr Capt Genll &Ca Sr Thomas Tench

    Esqr Coils Charles Hutchins Thomas Brooke Esqr James

    ffrisbey Esqr

   

   

      The sd Oath follows in these words Vizt

      The Oath of a Iudge of his Majesties most honoble Court

    of Appeals & writts of Error, according to an Act of Assem

    bly composed of his Majtes Governr & honoble Councill of

    Maryland.

      You do Swear that as Iudge of his Majtes most Honoble

    Court of Appeals and writts of Error in Maryland in all

    Articles, causes and things that shall or may come before you

    in Iudgment you shall do equall Right to the poore as well as

    to the Rich to the best of your knowledge, skill & Iudgment,

    according to the Laws, & constitution of England and this

    Province. All fines and Amerciaments that shall happen to

    be made and all fforfietures wch shall fall before you, you shall

    cause to be entred without any concealment and Certify the

    same to his Majesties Receivers of this Province you shall not

    debarr or hinder the prosecution of Iustice nor take any

    guift, ffee or Reward for the delaying of Iudgment; but shall

    behave and demeane your selfe justly and truly to the best of

    your understanding, so long as you shall continue in this

    Office or untill you shall be Lawfully discharged therefrom.

                               So help you God.

   

   

      Ordered that notice be given to the respective Counties

    that it was his Exncys intent to have seen the severall Troops

    & Companies this fall; but the Court comeing on & this dis

    turbance of Indians happening, he could not gett time, but

    intends (God willing) this Winter or in the Spring at farthest
