good and Substantiall Security taken for all Appeals &ca they Lib. H. D. shall at any time admit and allow off and that for all Chancery Writs where Security is required no persons be admitted for Security but what are of Sufficiency & Vallue.
Reference to Ordered that it be Referred to the Kings Law the Kings Lawyers abt yers to consult whether the Governr and Councill the Govr & Councils Constituted as a Court for hearing Appeals and taking an Oath Writs of Error &ca ought not to have a peculiar as a Court and proper Oath Administred to them and that they make Report accordingly. Not yet Answered. Vpon a Report of his Mats Lawyers Laid before this Board in Relation to Sundry Judgmts obtain'd against Severall persons upon Penall Navigation Bonds in Complyance to a former Referrence from this Board touching the Same—His Exncy is pleas'd to Reprsent that the last Sessions of Assembly he had made a Promise to the House of Delegates that Execution should be Stopped untill his Mats pleasure should be further known expecting the House would become humble SuitTs to his Maty on their behalf for taking their Case into his P. 504 Royall Consideration according as they then promised and had a Peticon drawn to that Effect; Upon which Considera tion and no other his Exncy made that promise, but finding nothing done therein, and that Severall of the persons agt whom such Judgmts are obtain'd, are Endeavouring to make away their Lands and Estates and so to defraud his Maty of those Judgmts and that he is advised by the Kings Lawyers that if the Judgments be passed a year and a day they Cannot be Renewed but by Scire ifacias which dilatory process would Retard his Maty of Recovering of his Right if it should be Required Sooner, besides Severall other Evasions and Illegall Methods taken for destroying his Mats Intrest in the sd Judgmts &Ca has Caused him to take measures accordingly, for prevention of those Illegal Courses and to Execute one Contrary to his first intent; the Referrence and Report follow in these words Vizt
