their Matys Councill in this their Matys province and Terri-
torys of Maryland, Now these prsents Wittnesses in Case the
said paymt be not Allowed of by his Maty but ordered to be
refunded then I the said Nicholas Greenbury do promise to
repay the same pursuant to such Order as shall be made by

his Maty therein.

Produced also Mr George Platers Depo as followeth Vizt

Maryland ss May the 25th 1698.

George Plater of Calvert County saith that att or about the
month of ffebry in the year of our Lord 1693 being att the
house of Mr Iames Brown of the City of St Marys in Company
of the honble Col Nicholas Greenbury and Thomas Tench

Esqr both of his Matys honble Councill of Maryland the honble
Sr Thomas Laurence Barrtt secry of Maryland produced an
Order of his Matys Councill of England for the reinstateing
the sd Sr Thomas in his former station of Councillor the said
Nicholas Greenbury did answer he was appointed president of
the Councill by Sr Edmond Andros therefore thought fitt to
Acquaint him therewith before he could give any possitive
Result in or Answer to Admitt him as president

After Consideration whereof and the Councill being heard
as well on the part and behalfe of the sd Sr Thomas Laurence
Barrt as also on the behalfe of the Exrs of Col Nicho Greenbury
Decd it Appearing to this Board that the said Col Greenbury
Notwithstanding her sacred Maty of blessed Memory her
Royall Mandate in Councill for takeing off the Suspencon
under wch the sd Sr Thomas then lay and also for restoreing
him to p'side as being first Nominated of the Councill had
delay'd to fulfill her sd Matys Comands alledging that in as
much as he had been Appointed prsident by his Exty Sr
Edmond Andros Knt Govr of Virginia (who upon the Death
of his Excy Lyonel Copley Esqr late Governor of this province)
took upon him the Governmt here by Virtue of a Certein
Comission wch he produced &c) he could not invest the sd Sr
Thomas or Resigne unto him the presidentship untill such
time as the sd Sr Edmond Andros should arrive here in person
to Execute & fulfill these her Royall Matys Comands in
restoreing the sd Sr Thomas Laurence; He the sd Col Green-
