their Matys Councill in this their Matys province and Terri-
torys of Maryland, Now these p^rsents Wittnesses in Case the
said paym^t be not Allowed of by his Maty but ordered to be
refunded then I the said Nicholas Greenbury do promise to
repay the same pursuant to such Order as shall be made by

his Maty therein.

Maryland ss May the 25^th 1698.

George Plater of Calvert County saith that att or about the
month of ffeb^ry in the year of our Lord 1693 being att the
house of M^r Iames Brown of the City of S^t Marys in Company
of the honble Col Nicholas Greenbury and Thomas Tench

Esq^r both of his Matys hon^ble Councill of Maryland the hon^ble
S^r Thomas Laurence Barr^tt secry of Maryland produced an
Order of his Matys Councill of England for the reinstateing
the s^d S^r Thomas in his former station of Councillo^r the said
Nicholas Greenbury did answer he was appointed president of
the Councill by S^r Edmond Andros therefore thought fitt to
Acquaint him therewith before he could give any possitive
Result in or Answer to Admitt him as president

After Consideration whereof and the Councill being heard
as well on the part and behalfe of the s^d S^r Thomas Laurence
Barr^t as also on the behalfe of the Ex^rs of Col Nich^o Greenbury
Dec^d it Appearing to this Board that the said Col Greenbury
Notwithstanding her sacred Maty of blessed Memory her
Royall Mandate in Councill for takeing off the Suspencon
under w^ch the s^d S^r Thomas then lay and also for restoreing
him to p'side as being first Nominated of the Councill had
delay'd to fulfill her s^d Matys Comands alledging that in as
much as he had been Appointed p^rsident by his Ex^ty S^r
Edmond Andros Kn^t Gov^r of Virginia (who upon the Death
of his Ex^cy Lyonel Copley Esq^r late Governo^r of this province)
took upon him the Governm^t here by Virtue of a Certein
Comission w^ch he produced &c) he could not invest the s^d S^r
Thomas or Resigne unto him the presidentship untill such
time as the s^d S^r Edmond Andros should arrive here in person
to Execute & fulfill these her Royall Matys Comands in
restoreing the s^d S^r Thomas Laurence; He the s^d Col Green-
